Drivers of buses, trolley buses, trams on regular city passenger routes are entitled to the early establishment of an old-age insurance pension due to special working conditions.

Who can retire early

Men at the age of 55 and women at 50 acquire the right to a pension if they have worked as drivers of buses, trolley buses, trams on regular city passenger routes for at least 20 and 15 years and have an insurance record of at least 25 and 20 years - respectively for men and women.

An early retirement pension is assigned to such employees if they constantly carry out full-time transportation on regular city routes. This type of transportation includes regular routes passing within the city limits (another settlement), performed by motor vehicles with an engine designed to transport passengers with more than 8 seats (in addition to the driver).

Regular passenger transportation includes transportation carried out with a certain frequency along the established routes with the embarkation and disembarkation of passengers at the stops provided for the route. In this case, the bus must leave for the flight on schedule, follow all intermediate checkpoints in a timely manner and arrive at the destination on schedule, taking into account the permissible deviations.

The specified information may be contained in a document such as a passport for the route. The passport for the route contains all the information that indicates that the route belongs to a regular city route (within the city) or to a route that does not belong to such, for example, a suburban route.

Work on urban passenger regular routes can be organized with a semi-express, express, regular mode of movement, or combine these modes during the day. At the same time, such drivers will enjoy the right to preferential pension benefits only subject to documentary evidence of permanent and full employment (at least 80% of working time) on regular city passenger routes.

How to prove the right to a preferential pension

The driver starts work on the basis of the waybill. On the reverse side of the waybill there are details to be filled in: departure time (according to the schedule and in fact) and arrival time (according to the schedule and in fact), on the basis of which it is possible to calculate the actual time in hours of the driver's work on the line on regular city passenger routes for a month. The flight is considered completed without violating the schedule if the bus departed on the flight exactly as scheduled, passed all intermediate checkpoints in a timely manner and arrived at the final destination of the route according to the schedule, taking into account the permissible deviations. According to the waybills, the driver's worked time is read.

In the absence of waybills as a document on the basis of which it is possible to calculate the actual time in hours of the driver's work on the line on regular urban passenger routes for a month, it is necessary to submit certificates from enterprises indicating documentary grounds (orders, personal accounts, payroll, collective agreements and etc.).

Who is not eligible for a preferential pension

It is worth considering that route taxi services do not belong to regular passenger traffic, but are special, since no regularity is established for them. In this regard, there are no grounds for granting the right to early retirement benefits to bus drivers operating in the mode of fixed-route taxi transportation.

Drivers working on suburban, intercity, specialized routes, as well as drivers performing charter transportation of passengers on routes that do not belong to regular city routes, or drivers of departmental transport transporting employees of an enterprise are not eligible for pension benefits.

Pension

The amount of early retirement pension for road transport workers is determined according to general rules. It depends on the duration of the total work experience and earnings before January 1, 2002, the total amount of insurance premiums received by the FIU for the insured person after January 1, 2002 to a personal account in the MPI system.

The procedure for confirming the periods of work, giving the right to early appointment of a labor (insurance) old-age pension, including for drivers of buses, trolleybuses, trams, employed on regular urban passenger routes, was approved by the Order of the Ministry of Health and Social Development of the Russian Federation of March 31, 2011. No. 258n "On approval of the Procedure for confirming the periods of work, giving the right to early appointment of an old-age retirement pension."

Today, the profession of a vehicle driver is not only the most widespread profession, but also the most in demand. Each of us knows what kind of stress and concentration this work requires in conditions of heavy traffic on the streets of our cities.
Such work leads to the appearance of specific diseases in professional drivers. Therefore, some drivers have the right to become pensioners 5 years earlier than they reach the generally established retirement age, but in order to exercise this right, they will need to fulfill a number of conditions established by pension legislation.

Conditions for early assignment of a pension to bus drivers.

1 . In accordance with part 10 of paragraph 1 of Article 30 of the Law "On Insurance Pensions" No. 400-FZ, an old-age insurance pension will be assigned five years before reaching the generally established retirement age (men at 55 years old, and women at 50 years old), if they worked as drivers of buses, trolley buses, trams on regular city passenger routes respectively, not less than 20 years and 15 years and have insurance experience, respectively, not less than 25 years and 20 years.

In accordance with the current legislation, regular urban passenger routes include the transportation of passengers within the city according to a schedule in accordance with the schedule approved by the municipal authority, with the embarkation and disembarkation of passengers at specially equipped stops, on a vehicle with more than 8 seats for passengers.

2. Applicants for an early retirement pension are required to accumulate at least 30 pension points (pension coefficients) in their personal account with the Pension Fund of the Russian Federation. In the period until 2024, fewer pension points are required, taking into account the transitional provisions in accordance with Article 35 of Law No. 400-FZ.

3. In accordance with paragraphs 4 - 6 of the "Rules for calculating periods of work, giving the right to early assignment of a pension ..." No. 516, the basis for granting the right to early assignment of a pension is work that is performed continuously during full working time and for which the corresponding insurance premiums have been paid to the Pension Fund of the Russian Federation. The periods of such work are counted in the employee's preferential length of service in a calendar manner, taking into account the periods of annual basic and additional leaves, as well as the periods of receiving benefits for temporary disability, including the periods of receiving benefits for pregnancy and childbirth.
■ If the driver of urban public transport performed work during a full working day, but in a part-time working week (due to a reduction in the amount of work), then such periods will be calculated based on the hours actually worked.
■ If a driver of a passenger motor transport company combines work on regular urban passenger routes with work on suburban routes, then such work can be credited to his preferential length of service only if employment on regular city routes is at least 80% of his working time.

4 . The work of drivers on regular city passenger routes in the period after 01.01.2013 is included in the preferential length of service, provided that the employer pays insurance premiums to the FIU at ADDITIONAL rates.
At the workplaces of drivers, a special assessment of working conditions (SOUT) must be carried out and a "harmful class of working conditions" is established for them.

Important . Information that the work qualifying for early retirement was performed full-time on regular city passenger routes must be documented.
Documents confirming the fact of such work may be orders for the appointment of an employee to work as a driver on regular city routes, as well as waybills, route sheets, personal accounts, payroll and other documents that contain relevant information.

Early retirement pension for truck drivers

In addition to city bus drivers, truck drivers who have worked for at least 12 years and 6 months - men and 10 years - women, directly in the technological process in mines, open pits, in mines or ore quarries for the export of coal, shale, ore, rocks and have an insurance record of at least 25/20 years (male / female)

Drivers will be able to retire on an early retirement pension five years earlier, writes Primorskaya Gazeta with reference to the State Duma website.

This bill was introduced to the State Duma by Deputy Oleg Nilov. According to the document, male drivers can retire at 55, and women at 50. At the same time, their professional experience must be at least 12.5 years and 10 years, and the insurance experience must be at least 25 and 20 years.

The document says that these rules apply, “if they have worked as car drivers under an employment contract on cars belonging to organizations registered in the Russian Federation, regardless of organizational and legal forms and forms of ownership, departmental affiliation, individual entrepreneurs and other persons carrying out transportation activities on the territory of the Russian Federation, including drivers engaged in international transportation, as well as working in rotational teams with a rotational method of organizing work, in intercity transportation when sending drivers on long-distance flights, in which the driver does not can return to a permanent place of work. "

Thus, along with the drivers of buses, trolley buses, trams, who already have the right to an early retirement pension, this prerogative will now be enjoyed by truck drivers, taxi drivers and others, and a new clause will be added to the Federal Law "On Labor Pensions in the Russian Federation".

According to the head of the company Trans-Line LLC, which is engaged in the transportation of goods in the Primorsky Territory, this initiative is necessary and will make life much easier for drivers.

There are several drivers working in our fleet, and it is worth noting that this work is nervous, hard and low-paid, - says Mikhail Yakovlev. - This initiative will make life much easier, I am completely in favor of the adoption of this amendment in the State Duma.

He is supported by the chairman of the regional branch of the all-Russian trade union "Taxi Driver" Sergei Davydov.

Any taxi worker will tell you that their job is not easy and it can be easily attributed to the activities of public transport drivers, who already have such a prerogative, - said the chairman of the trade union. - I fully support this initiative, it will not interfere with our legislation.

According to Vyacheslav Glushko, chief physician of the City Clinical Hospital No. 2, this bill is needed, since the profession of a driver is associated with certain difficulties.

Drivers are a difficult profession. They most often go to the hospital with diseases of the musculoskeletal system, hernias and osteochondrosis. In addition, people of this profession most often endure colds, as they say, "on their feet", which is why they subsequently have various complications. This can also include malnutrition, as a result of which there are problems with digestion, - said the head of the "thousand-bed" hospital.

1. Payment of wages to the employee at the place of work or transfer to the bank account specified by the employee every half a month within the time frame specified in the collective agreement.

2. Payment for sick leave, depending on the length of service, but not more than the maximum amount of benefits for temporary disability, for pregnancy and childbirth, provided for by law.

3. Provision of annual paid regular vacations:

  • all employees of the State Unitary Enterprise "Mosgortrans" - 28 calendar days;
  • disabled people, WMO employees - one calendar month;

5. Provision of guarantees and compensations to employees who combine work with training (when receiving an education of the appropriate level for the first time) in educational institutions that have state accreditation and successfully study in these institutions.

6. Payment of wages to apprentices of bus, trolleybus and tram drivers during the training period.

7. To encourage employees who have made a great personal contribution to the achievement of positive results of economic activity, as well as in the elimination of the consequences of emergencies:

  • cash bonuses are paid;
  • awarded badges, certificates of honor, diplomas;
  • the best employees are listed on the Hall of Fame;
  • other promotions.

8. Professional training, retraining and advanced training.

9. Granting a pension on preferential terms for working on regular city passenger routes to bus, trolleybus and tram drivers working on regular city passenger routes when they reach age:

  • men - 55 years old (with 20 years of work experience);
  • women - 50 years (with 15 years of work experience).

10. Provision of preferential pensions to certain categories of workers according to List No. 2 of industries, jobs, professions with harmful and (or) dangerous working conditions.

11. Conducting preliminary (upon admission to work) and periodic medical examinations of drivers and workers employed in work with harmful or hazardous working conditions.

Additional social benefits and benefits provided for by other agreements, local regulations

12. Purchase of travel documents for ground passenger transport (bus, trolleybus, tram).

13. Payment of vouchers (from the funds of the enterprise, the fund for the development of the social sphere, the city committee of the trade union and the funds of the branches) to summer health camps (departmental) in the amount of up to 90% of their value.

14. Organization of hot meals for workers at the end stations (where it is provided for by the route schedule) and in canteens on the territory of the branches.

15. Partial or full payment for vouchers to recreation centers and to a boarding house with treatment by the State Unitary Enterprise "Mosgortrans" within the limits of available funds.

16. Partial or full payment of vouchers for treatment within the available funds.

17. Partial or full payment for vacation vouchers, excursions, visits to cultural and sports events, corporate recreation evenings within the limits of available funds.

18. Provision of corporate clothing for controllers of passenger transport and drivers working on regular city (suburban) passenger routes, on registered and school transportation.

19. Providing children and grandchildren of employees with free tickets for children's New Year's performances or New Year's gifts.

20. Medical care for all categories of workers in the assigned city medical institution and health centers of the branches.

Despite the rather skeptical attitude of many, the profession of drivers in the field of passenger transportation was recognized as especially difficult. At least, the Ministry of Transport and the departmental all-Russian trade union of drivers have ensured that the certification of their working conditions will now take place according to revised parameters, taking into account not only general, but also specific factors that expose the particular complexity of the work of a public transport driver. The initiators of the reassessment of the parameters refer to the conclusion of occupational pathologists, who argue that public transport drivers have to work in conditions of constant stress, therefore, they have the spread of cardiovascular diseases. Moreover, the specificity of the work leads to the development of sciatica.

Due to the severity of the work, drivers are even entitled to an early preferential pension. But, they often find themselves deprived of such a right due to imperfect checking of working conditions. To rectify the situation, the Ministry of Labor promises to revise the parameters for checking jobs by the middle of this year.

Biased assessment

According to the Federal Law “On Labor Pensions in the Russian Federation”, drivers of public transport are entitled to an insurance old-age pension until they reach retirement age. Such a right arises for men at 55 years old and for women at 50 years old, provided that their work experience is 20 and 15 years, respectively, and their total insurance experience is 25 and 20 years, respectively. But age and seniority, as it turned out, are not the main criteria. According to the head of the driver's trade union, Vladimir Lomakin, whose words are quoted by Izvestia, a preferential pension is awarded to drivers of public transport only in those cases when, after checking the working conditions, the level of harm caused to the driver's health is recorded. Otherwise, one cannot count on benefits. By the way, the assessment of jobs is carried out every 5 years by a special licensed organization, which is hired by a transport company.

According to Lomakin, even the same jobs can be valued differently.

The human rights defender has repeatedly had to deal with a situation where the assessment was carried out unprofessionally, as a result of which, in fact, harmful work ceased to be considered as such. Interestingly, the company is interested in such an outcome, because harmful working conditions oblige the employer to pay compensation to employees. This is also confirmed by the Ministry of Transport, referring to the possibility of different interpretations of the assessment criteria, as a result of which drivers are deprived not only of additional payments, but also of the right to a pension.

The Ministry of Labor confirms that, in fact, the assessment of the working conditions of drivers is carried out according to general rules and takes into account standard criteria. The department even conducted a study, where they studied the features of the practical assessment of working conditions over the past three years. And as a result, it confirmed that the assessment methodology is imperfect and simply does not take into account the conditions that make working on public transport not only difficult, but also harmful.

Trade unions estimate that over the past 3 years, about a quarter of all urban transport jobs assessed during this period received a lower occupational hazard class than was previously determined. Drivers' rights advocates believe that the assessment of driving jobs by private organizations is biased. And this, in their opinion, is due to the interest of employers.

Have achieved revision

With sufficient evidence of unfair assessment, unions began to seek support from the Ministry of Transport. Thanks to the latter, it was possible to "promote" the initiative, as a result of which the Cabinet of Ministers decided until mid-2017 to clarify and legalize the specifics of assessing jobs for drivers of public transport. But that's not all: Lomakin assures that the trade unions will seek to decouple the right to a preferential pension from the assessment results - it should come regardless of the results of the audit conducted by private organizations. And since tension should be considered the main harmful factor in the work of drivers, appropriate standards should be introduced.

For example, until 2014, during the certification, a guide was used that provided for more than two dozen parameters of the intensity of driving work. Today there are only 6 of them left. and they cannot reflect the real state of affairs. Occupational pathologists assure that, even if other limit indicators of harmfulness are observed, it is impossible to exclude stress and nervous tension. Doctors note that driving stress has the greatest effect on the cardiovascular system - during a mass examination, diseases of this kind were detected in more than 75% of cases... But diseases of this kind are far from the only problem for drivers. They are often diagnosed with ulcers, radiculitis, bronchitis and a number of other chronic diseases, most likely caused by the specifics of working conditions.

The Ministry of Transport assures that over the past two decades, the intensity of city traffic has grown at least fivefold. There is no doubt that complex traffic, in which urban transport drivers have to stay for 8-10 hours a day, cannot but create excessive tension. And besides the environment, not the most maneuverable public transport is also a source of danger on the road. With all this, the driver of this transport is responsible not only for his own life, but also for the lives of passengers. And in such conditions, neuroses and emotional breakdowns are far from uncommon. So benefits for representatives of such professions are quite an adequate compensatory measure.
