Working hours

Working hours- this is a certain number of hours that the employee works in accordance with the labor, collective agreement during a certain calendar period.

Working hours are needed to establish working hours. The working time is calculated according to the schedule of a five-day working week with two days off on Saturday and Sunday based on the duration of daily work. This is provided for by the Procedure approved by the order of the Ministry of Health and Social Development of Russia dated 13.08.2009 No. 588n. Note also that the duration of the working day or shift preceding a non-working holiday is reduced by one hour (part 1 of article 95 of the Labor Code of the Russian Federation). In 2016, it will be possible to work one hour less on February 20 and November 3.

Labor rate of working time. Weekend work

If an employee works in excess of the monthly norm of working hours, work on the day off must be paid at least double the amount in excess of the salary. Or in a single amount in excess of the salary if the employee works on weekends within the monthly norm (Article 153 of the Tax Code of the Russian Federation). The code also says that the employee does not need to pay for the day of rest, which is provided for work on the weekend. At the same time, the day of rest is excluded from the norm of working hours per month. If other days have been worked out, then the employee must be paid a full salary for a month. This is the opinion of officials (letters from Rostrud dated February 18, 2013 No. PG / 992-6-1, Ministry of Labor of Russia dated March 11, 2013 No. 14-2 / ​​3019144-1157).

The amounts that the employer charges in accordance with the legislation are taken into account in labor costs (Article 255 of the Tax Code of the Russian Federation). This means that the company has the right to take into account the full salary and the daily rate for work on weekends in excess of the salary in its income tax expenses. Officials adhere to the same position (letter of the Ministry of Finance of Russia dated 07.14.15 No. 03-03-06 / 40358).

Working in excess of the norm of working hours

The irregular regime does not depend on the type of activity of the company (Article 101 of the Labor Code of the Russian Federation). The list of positions with irregular days must be determined in the collective agreement or order of the head.

For example, employees who provide consulting and legal services can work in excess of the working hours. Clients often ask questions after 6 p.m., which is why companies set irregular working hours for some employees.

It is possible to establish irregular working hours for all employees, but it is unlikely to be justified. After all, this is a special regime in which individual employees can be occasionally involved in work outside of the set time. If you set an irregular day for everyone, then when checking it can be regarded as a hidden form of overtime work.

The Code does not explicitly prohibit setting irregular days for all employees. From Article 101 of the Labor Code of the Russian Federation it follows only that it is impossible to constantly involve all specialists outside working hours. This means that you can set an irregular schedule for everyone, but involve employees in this mode one by one.

Holidays, weekends and working days are established annually by the government of the Russian Federation. So the production calendar for 2016 has 119 weekends and holidays, and 247 workers. We remind you that 2016 is a leap year, so there will be 29 days in February, not 28, so there are a total of 366 days in a year. For 2016, in accordance with the Labor Code of the Russian Federation, Art. 112, the following non-working days and holidays are established:

  • The men's holiday called “Defender of the Fatherland Day” will be celebrated, as usual, on February 23rd.

  • The holiday dedicated to Spring and Labor is scheduled for May 1.
  • Victory Day in the Great Patriotic War is celebrated on May 9.
  • Day of Russia will be celebrated on June 12.
  • National Unity Day is celebrated on November 4th.

State authorities on the basis of regulatory legal acts and laws, in accordance with the Labor Code of the Russian Federation, Art. 6, additional public holidays may apply. Such a norm is indicated in the letter of the Ministry of Labor of the Russian Federation No. 1139-21 dated 10.07.2003, clause 8, and this is also indicated by the Resolution of the Presidium of the Supreme Court No. 20-PV11 dated 21.12.2011. So, religious holidays can not be recognized as additional non-working holidays, in accordance with the procedure specified in Federal Law No. 125-FZ of September 26, 1997, Art. 4, item 7.

Postponing holidays in 2016

For the purpose of rational use of non-working holidays and weekends by employees of organizations, they can be postponed to other days, this measure is enshrined in regulatory legal acts by the Government of the Russian Federation or federal laws for the coming year, taking into account the future calendar.

The transfer of holidays in 2016 in accordance with the Decree of the Government of the Russian Federation No. 1017 dated 09.24.2015 "On the transfer of weekends in 2016" will be as follows:

  • Saturday 2 January is postponed to 3 May.
  • Day off Sunday, which falls on January 3, will be postponed to March 7.
  • Monday 22 February will also be a day off as a result of the postponement from 20 February.

As a result, we get longer weekends:

  • New Year's holidays in 2016 will be celebrated from January 1 to 10, their duration will be 10 days.
  • The men's holiday will stretch for 3 days thanks to the postponements for the period from 21 to 23 February.
  • The duration of the celebration of International Women's Day will be 4 days - from 5 to 8 March.
  • May holidays will bring a total of 6 weekends: from 1st to 3rd and from 7th to 9th May.
  • The celebrations in honor of the Day of Russia will last 3 days - from 11 to 13 June.
  • Russians will also celebrate the Day of National Unity for 3 days: from 4 to 6 November.

Working hours for 2016

Order of the Ministry of Health and Social Development of the Russian Federation No. 588n dated 08/13/2009 determines the procedure for calculating the working time norm for 2016, depending on the working week established in the organization, which can be set as five days, with working days from an accomplice to Friday, and weekends on Saturday and Sunday. Thus, a 40-hour work week assumes an 8-hour work rate, a 36-hour week implies a 7.2-hour rate, and for a 24-hour work week, the rate will be 4.8 hours.

In accordance with the Labor Code of the Russian Federation, Art. 1, the duration of the work shift or the day immediately preceding the holidays will be reduced by 1 hour, so in 2016, citizens will work one hour less on November 3 and February 20. This norm will apply to all work regimes of employees and the rest provided to them.

Article 6 of the Labor Code of the Russian Federation, laws and other regulatory legal acts of state authorities of the constituent entities of the Russian Federation may establish additional non-working holidays. This norm is also contained in the Decree of the Presidium of the Supreme Court of the Russian Federation dated December 21, 2011 No. 20-PV11 and in paragraph 8 of the letter of the Ministry of Labor of the Russian Federation dated July 10, 2003 No. 1139-21.

Additional non-working holidays can be declared religious holidays in the manner prescribed by part 7 of Art. 4 of the Federal Law of September 26, 1997 No. 125-FZ.

Postponement of non-working days

According to part five of Article 112 of the Labor Code of the Russian Federation, for the purpose of rational use of weekends and non-working holidays by employees, weekends can be postponed to other days by federal law or a regulatory legal act of the Government of the Russian Federation

Decree of the Government of the Russian Federation of September 24, 2015 No. 1017 "" postponed the following days off:

  • from Saturday 2 January to Tuesday 3 May;
  • from Sunday 3 January to Monday 7 March;
  • from Saturday 20 February to Monday 22 February.

Thus, taking into account the postponement of weekends in 2016, the "New Year holidays" for employees will last 10 days - from January 1 to 10, 2016.

In May 2016, non-working days will be days from May 1 to May 3 - the Spring and Labor Day, as well as from May 7 to May 9 - the Victory Day holiday. In June, the holiday period in connection with the celebration of the Day of Russia will last from 11 to 13 June, and in November, the holiday of the Day of National Unity - from 4 to 6 November 2016.

Working hours

In accordance with the procedure approved by Order of the Ministry of Health and Social Development of Russia dated 13.08.2009 No. 588n, it is calculated depending on the established working time per week according to the estimated schedule of a five-day working week with two days off on Saturday and Sunday, based on the duration of daily work (shift). Thus, with a 40-hour working week, the norm of working time will be 8 hours, with a working week of 36 hours, it is equal to 7.2 hours; with a 24-hour work week, it will be 4.8 hours.

In accordance with part 1 of article 95 of the Labor Code of the Russian Federation, the duration of a working day or shift immediately preceding a non-working holiday is reduced by one hour. In 2016, workers will work one hour less on February 20, November 3.
