Before opening a business, you need to try to carefully study the standards relating to its organization. You can find out about them by contacting the territorial bodies of Rospotreb and Gospozhnadzor. First of all, in order to organize your own children's center, you need to find the optimal premises. Let's return to the question of choosing an area for the location of your center. It does not depend on your preferences and convenience, but on the target audience you are targeting. Assess your financial capabilities. A children's center that claims to be in a high price segment, with excellent repairs, the most qualified teachers, a professional administrator and demanding clients, will not be cheap. Such an establishment should be located in the city center, where rent will cost a pretty penny.

For a simple kids club with a low cost of classes, even the first floor of a multi-storey building in a residential area is suitable. Decide in advance on those areas that do not suit you unambiguously in terms of remoteness (you also have to go to work every day) and / or according to the contingent and ability to pay, competition and other factors. The area of ​​your premises also depends on the goals and objectives. The study room (if there is one) must be at least 30 sq. meters. Some kids clubs open in office buildings or shopping malls. Ideally, they should be located on the lower floor so that little ones do not need to climb the stairs or in the elevator. In this case, there may be several training rooms, but, most likely, they will be small in area.


In any case, there should be a waiting room in your center. Often, the heads of the centers try to save on rent and do without it. However, many parents will wait for their children while they study. If they have to stand outside all this time, they are unlikely to walk to your center for a long time, no matter how good it is.

Taking into account classrooms, a waiting room (or hall) and a bathroom, the area of ​​the children's club should be about 50 sq. meters. On the other hand, the main rule of a rented space is that every meter of it should bring you profit. Therefore, renting or buying a large area that you simply have nothing to occupy is also not worth it. When searching for a room, it is necessary to take into account the norms of the SES and the fire authorities. For example, a child care center cannot be located in a basement, semi-basement, or basement floor. The premises should be well ventilated, have a separate entrance and a separate bathroom. Convenient access to your center and the availability of a parking space are of great importance (this is especially true for the city center, where it is very difficult to find a free space during rush hour).

One of the main conditions for the success of your establishment is its staff. Moreover, it includes not only the teachers themselves, but also the administrators. True, it will be easier to find a good administrator than a teacher who loves and understands children, knows how to find an approach to them and captivate them with any activity. Students or recent graduates can be hired as administrators who will answer phone calls, receive visitors, schedule classes, and resolve other organizational issues. Administrators work, as a rule, in shifts. At first, you can take on their responsibilities, unless, of course, you yourself are going to conduct classes.

It is much more difficult to find good teachers. Qualified teachers with extensive experience in kindergartens or even schools will not be cheap, but worst of all, the presence of a special higher education diploma, certificates, diplomas and other documents does not at all guarantee that your teacher will be able to find a common language with children, and will not beat off they have all the desire to learn. According to the new Federal Law "On Education", an individual entrepreneur has the right to officially conduct educational activities with the involvement of other teaching staff, but for this he needs to obtain an appropriate license by January 1, 2014.

In the near future, by-laws are expected to be issued that will clarify the procedure for obtaining a license for an individual entrepreneur and the conditions that such a preschool educational institution and its employees must meet.

When children's centers need a license - in "Dele"

Let us remind you that if a children's center is engaged in educational activities, it needs a license and cannot work without it. We talked about this in the last article. But there is an exception: if an individual entrepreneur works personally, without staff-teachers, a license is not required.

All other clubs without a license are not required to teach anything. But here's what they can do:

  • look after the children;
  • entertain;
  • conduct classes for socialization and general development.

Let's take a look at what can and cannot be done by children's centers in each of these cases.

You do not need a license if the individual entrepreneur works personally and does not hire teachers

In 2013, the law divided entrepreneurs:

  • work on their own, do not hire teachers in the staff - no license is needed;
  • opening children's clubs and hiring teachers in the state - a license is needed. And managers will have to get a crust of "Management in Education", three-month distance professional retraining courses are enough.

To open a children's club without a license, an entrepreneur must work on his own, without hired teachers. To do this, he will have to receive specialized education. For example, for painting courses, a higher education diploma "Fine Arts Teacher" or a secondary education in the specialty "Painting" is suitable. If he is an economist by education, it is enough to take retraining courses, for example, under the program "Fine art teacher in organizations of additional education."

You can hire an administrator, cook, instructor, cleaner or nanny on the staff, but you cannot hire a person with the position of educator, educator, teacher, teacher, methodologist in the work book.

Such clubs need to choose the OKVED code 88.91 - "Provision of day care services for children", it refers to social services. With such an OKVED it is necessary to deal with social services. If you start preparing for school, it can be detected by a test. At best, it will get by with a requirement to obtain a license or a warning, at worst - a fine or even suspension of the club's activities.

Children's club "Rainbow" was engaged in the supervision and care of children. The prosecutor's office came to the club, because twice a week they taught the children to prepare for school. The prosecutor's office found signs that the club was engaged in educational activities:

  • textbooks, recipes, workbooks;
  • an offer agreement with the cost of classes in the "Know-ka" group, which mentions a preschool program for children 5-6 years old;
  • teaching materials and manuals in the study room.

Children are entertained in the club

There are entertainment clubs in almost every shopping center: you can leave your child there while you shop, or order a holiday, show program, quest. The club has a lot of toys, labyrinths, trampolines, slides, and animators, instructors, organizers work with children. You can come and go at any time. There are no fixed classes, and parents pay by the hour or by the activity.

Such clubs operate under OKVED 93.29.9 - "Other entertainment and entertainment activities."

The club conducts general developmental classes

In the club with children they are engaged in creativity, dancing, sports. This is similar to educational activity, but classes do not have all the signs of educational activity and other OKVED codes.

Club activities are chosen by entrepreneurs who do not consider their activities educational. They call the centers leisure centers, hire childcare professionals and instructors, and operate without an educational program or fixed schedule.

Natasha goes to the club for modeling and art therapy classes. Sometimes mom has no time to drive her daughter, and she misses classes. But it doesn't matter: the club does not have a rigid schedule, no one evaluates the result. The main thing is that the child likes it.

From OKVEDov 90.04.3 is suitable - "Activities of club-type institutions: clubs, palaces and houses of culture, houses of folk art."

With club activities, not everything is clear. In 2013, the Ministry of Education described how to organize additional education and listed its forms:

  • clubs,

  • theaters.

Nothing prevents circles, clubs and sections from being educational. Court decisions in club cases are different. Sometimes the courts side with entrepreneurs.

The Prosecutor's Office and the Ministry of Education checked the "Merry Peas" children's club. The inspectors interviewed the owner, checked the website and documents, and found this:

  • preschool education program "Childhood";
  • schedule of classes for children of different ages;
  • contracts with parents for training in an educational program;
  • labor contracts with teachers - educator and speech therapist;
  • job description of the educator with a description of his duties as a teacher;
  • medical books of teachers.

The court ruled that the club was engaged in educational activities and fined him 4,000 rubles.

Educational activity is a set of features: consistency, result, commitment, duration, consistency. To prove that a license is not needed, you will have to show that there are no such signs in classes, and confirm this with contracts and other documents.

The opinion of the owner of the kids club

Mikhail (this is an assumed name) has children's centers in two cities and a franchise network. He told me what he thinks about licenses.

- I have two children's centers. In them we prepare children for school, do mental arithmetic, speed reading and calligraphy. Such centers did not need to be licensed until a new education law was passed in 2013.

One of my children's centers is licensed. Fifteen years ago, I began to pursue continuing education for adults, organized continuing education courses and obtained a license for continuing education. Later I just added activities for children.

When I opened a second club in a shopping and office center, I also wanted to license it. We invited a fire inspector to check the premises, he knocked on the walls and said that the plasterboard partitions would not work. It was costly to change location, but that's not even the problem. In our city there are almost no premises with a fire exit and three toilets, as is required for children's centers. Or the rental price is such that the kids' club can't afford it.

If you license a club, checks will come every three years. I prepared for the last one for three months, lost four kilograms. But when there is no license, you are not on the list of the Department of Education, and the check will come only if there is a complaint or force majeure. Therefore, I did not license one of the centers.

I veiled my educational activities: I took the club OKVED, I designed the teachers as instructors-moderators. We don't teach anyone, we just spend time learning English. This is how many centers work.

For the center to develop, teachers are needed. But if there are teachers on the staff, you need a license. To avoid licensing, managers either do not register teachers in any way, or register them as consultants and instructors under an employment contract.

Sometimes an individual entrepreneur takes OKVEDy "rent" and "consulting activities", invites other individual entrepreneurs with a pedagogical education and rents their premises to them. That is, the entrepreneur himself does not keep the club, but gives the place for classes with children. He does not need a license, and neither does the invited entrepreneurs - each of them works by himself. Everyone seems to be fine. The problem is that then each teacher needs to open a current account, set up an online cashier and receive money, conclude agreements with parents. Not every teacher will do this.

Eight staff members oversee educational activities in the region. According to the plan, they check kindergartens, schools, art houses and everyone who already has a license. They have no time to run around the clubs. We also try not to give a reason for inspections and to comply with the laws: we officially register, pay taxes, and honestly deal with children.

- Requirements for small clubs with educational activities seem excessive. It is difficult for a club with two teachers and a couple of classes to follow the rules that are written for creative houses with four hundred children. But there are requirements of the law that relate to life and health, they must be fulfilled. For example, the law prohibits the opening of clubs in the basement because there is not enough daylight and fresh air.

You can work with restrictions. If the basement has full windows and good ventilation, I recommend inviting Rospotrebnadzor for a consultation. They will inspect the premises and can approve it.

An individual entrepreneur does not need to receive an opinion from the Ministry of Emergencies to obtain a license. But the fire safety rules must be observed. Otherwise, the club may be fined during the check. To calculate fire risks, you can contact a company that does fire audits. She will tell you how to proceed.

Finding the right space is the hardest part. I understand those who opened five to ten years ago: the place is familiar, you don't want to leave and is expensive, as Mikhail says. But, if the manager decided to do this business seriously, I would recommend preparing for the move.

Routine inspections usually take place every three years. In education, social services, health care and some other areas - every two years. It happens that scheduled inspections do not come at all. The reason for an unscheduled one is a complaint or a decision of the prosecutor's office.

Entrepreneurs often say: “I will work as I did. What threatens me if they come? I'll pay the fine. " But in addition to the fine, the reviewers will write a list of requirements that need to be corrected. If the requirements are ignored, there will be a court and, possibly, the suspension of the club's activities. In other words, the owner either fulfills the requirements of the auditors, or is closed.

If children are engaged in a club with a license, parents can receive tax deductions, pay for classes with maternity capital, and in the future - and certificates of additional education.
