The pension of the combatants (hereinafter referred to as the participants b / d) has common features with the formation of a pension among veterans of the Great Patriotic War (WWII for short), but with its own individual characteristics, therefore our article is devoted to the peculiarities of calculating pension payments to veterans.

Features of the formation of a pension

Participants of the b / d are employees of the Ministry of Internal Affairs (for short, the Ministry of Internal Affairs) who carry out direct orders to resolve armed conflicts.

  • military - police officers; criminal structures that took part in battles on foreign territories;
  • civilians sent to serve in Afghanistan from 1978-1989.

A complete list of persons participating in battles is enshrined in Article 3 of Federal Law No. 5 "On Veterans" dated January 12, 1995 (hereinafter FZ-5). Veterans can be: citizens of the Russian Federation; foreigners who have lived in Russia for a long time; persons without civil rights.

Features of the appointment of pension payments

According to the law No. 4461-1 of 02/12/1993, non-domiciled participants have the right to receive two pensions: basic and "veteran". The basic pension depends on the length of service, seniority, position, rank, allowances. And the second - 2 600 rubles .

Bills

1. Pension issues are regulated by Federal Law No. 4468 -1 of 12.02.1993. Important fragments of the law:

  • Provides for three types of pensions: length of service, disability, loss of breadwinner. The amount of the pension directly depends on the size of the monetary remuneration of each war veteran;
  • The pension increase is 32%;
  • The pension is paid to family members of a deceased veteran b / d in case of death in the course of work. In case of late application, pension savings are paid for the previous period without time limits.

Benefits for veterans b / d

The Federal Law-5 contains a list of the main preferential tariffs for veterans, for example, the following:

  1. reduction of tax deductions;
  2. pension supplements;
  3. provision of real estate;
  4. discounts on utility bills;
  5. receiving free assistance from medical institutions and so on.

The process of registration of a participant's pension b / d

  1. Registration is carried out at the military registration and enlistment office at the place of residence.
  2. Obtaining documents on participation in battles.
  3. The presence of a certificate. Persons with the status of a veteran of military operations are required to obtain a certificate. It includes the following data: title of the documentation; FULL NAME; the name of the government agency; passport data; the photo; list of preferential terms; date of issue; signature of the owner and official.

    The stamp on the ID must be on the right and left inside the document!

    To issue a certificate, it is necessary to prepare: a military ID, a personal file, papers confirming the presence of wounds, an extract from the order for appointment to a position, awards, a flight book, an archive certificate to confirm participation in battles. The entire list must be submitted to the central commission, which, after a period of 30 days, issues (or refuses) a certificate. Every veteran is obliged to register the certificate after receiving it in the ledger;

  4. Registration of a personal bank account.
  5. Contacting the Pension Fund (hereinafter referred to as the PFR). The main list of documentation includes: passport data; photo size 3 × 4; papers confirming the existence of awards; employment history; papers on participation in battles; veteran's certificate; papers by disability group (if assigned). The entire list is provided in several ways: with your own hand, through the principal, the Internet, by the Russian Post.

The pension can be obtained through the military commissariat, not the PFR!

Consideration of the documentation by the staff of the Pension Fund of the Russian Federation within 10 days, as a result of which a decision is made whether the applicant should amend the documentation or assign pension payments to the veteran.

The approximate size of the pension is up to 30 thousand! It is formed as a result of the annual indexing. In addition, the size of pension contributions is influenced by: seniority; territory of hostilities; injuries and trauma; disability group.

Pension supplements

The issue of regulating additional payments is enshrined in the Federal Law-319 of 03.12.2007; article 45.46 FZ-319 of 03.12.2007.

The basic supplement is 32% of the basic amount of the pension. To receive the specified payment, you need to prepare documentation for the PFR employees, namely: a passport; application in the form of the FIU; employment history; military ID; papers confirming the fact of participation in battles.

The entire list can be submitted in person, via the Russian Post, through a proxy, Internet resources.

Participants b / d in Chechnya, Afghanistan, Ukraine

To combatants in Chechnya

Individuals who participated in the war with Chechnya at the end of the 90s have a new status as a veteran of hostilities. The specified status is set:

  • soldiers, officers who served in Chechnya;
  • travel employee;
  • employees who were purposefully sent to a hot spot;
  • persons directly participating in the war.

A Chechen veteran must have a certificate.

FZ-5 provides Chechen employees with benefits and increased pensions. So, in the presence of a certificate, a citizen has the right to an increased pension, as well as the right to monetary remuneration (shortly, the EDV), which is not taxed.

Pensions of military participants in Chechnya

The Chechen servicemen's pension consists of a basic part and additional payments from the state. The average level of social payments is 4,770 rubles, and the amount of additional payments is 10,000 rubles.

Citizens who were injured while performing official duties in Chechnya are entitled to a number of allowances, such as, for example: Group 1 - 3137 rubles; 2nd - 2240 rubles; 3rd - 1793 p.

The size of the pension depends on the period of service, the size of the salary, and the period of work in Chechnya. However, payments must be at least the minimum subsistence level in the country.

Participants b / d in Afghanistan


Persons who served in Afghanistan receive the status of war veterans (WWII). The main groups of Afghan war veterans include: servicemen sent by the country to participate in battles; employees of the automotive military unit; pilots; aircraft crew members; employees who were posted to Afghanistan from 1979-1989.

When calculating pension payments, the PFR employees form it on the basis of an algorithm of actions, which is intended for pension contributions to veterans of the Great Patriotic War. The main difference is the change in the length of service - 1 year is equal to three years of experience.

The indicators of pension payments depend on such factors as: length of service, length of service, the position held by a participant in a b / d in Afghanistan. The main condition is that the pension should not reach the subsistence level. In this case, the state provides for a number of allowances and benefits. As a result, the average pension level among the participants of the b / d Afghanistan is 8000-9000 rubles.

And from 02/01/2016, the pension was increased by 7% due to indexing. And beneficiaries who decided to refuse social assistance received an increase in the amount of 3696.4 rubles.

A special kind of veterans are disabled people who were wounded during the battle in Afghanistan. People with disabilities have received such supplements to their pensions as: the first group receives a term of service pension increased three times; the second group can receive a doubled pension; the third is a 1.5-fold increase in pension payments.

Participants b / d in Ukraine

The main groups of participants in Ukraine's b / d are recorded in article 5 of the Law of Ukraine "On the status of war veterans and guarantees of their social protection" (briefly the ZU), which include the following categories of persons:

  • servicemen who carried out official assignments in a foreign territory;
  • the military sent to Afghanistan;
  • persons in charge of the automobile battalion;
  • flight personnel.

Pension contributions are formed on the basis of the Law of Ukraine "On Compulsory State Pension Insurance", which directly depend on the total period of work in hot spots, the salary of an employee.

From the beginning of 2012, additional allowances will be paid to disabled people and veterans of the non-profit if the amount of the pension does not reach the minimum indicators in the country.

According to the Law of Ukraine "On improving the financial situation of participants in hostilities and war invalids", veterans are entitled to a monetary bonus in the following amounts: 1 group - 70 UAH; 2.3 groups - 50 UAH; veterans b / d - 40 UAH

Pension for participants b / d in 2017

According to the latest data, in 2017 it is planned to index pension payments by 5.5%. Such a small percentage of the increase in the pension payments of a combatant is associated with the country's economic difficulties. Consequently, the actual size of the increase in pension directly depends on the general situation in the country.

In addition, local authorities are involved in the formation of additional benefits, which have the right to introduce preferential tariffs for all retirees, including for veterans of the b / d. Therefore, a pensioner must clarify the purpose of benefits in each separate region of the country.

Since there was no second indexation of pensions in 2016, the state decided to introduce a lump sum payments in the amount of 5 thousand rubles at the beginning of the new 2017. The period of "bonuses" to pensioners is January 2017. According to preliminary estimates, the state will spend 220 billion from the budget for the implementation of this task. But since the payment is a one-time payment, it will not harm the state budget, unlike a full-fledged indexing procedure.

Participants in hostilities are equated with the status of WWII veterans. Consequently, the procedure for calculating pensions is similar to the formation of pension payments among war veterans. However, a member of a b / d has different indicators of experience, length of service, salary, therefore the final level of pension is extremely individual and has a number of features, which we described in our article.

Due to ignorance of the laws, combat veterans miss the opportunity to enjoy certain benefits that can save their budget from unnecessary spending. Therefore, taking into account the latest news, we will consider in detail what benefits to veterans of military operations in 2019 will operate on the territory of the Russian Federation and whether they will differ from benefits in 2018.

War Veterans Benefits 2019

Next year, as well as this year, benefits to war veterans will be provided both at the federal and regional levels.

At the federal level, their provision is regulated by the following regulatory legal acts:

  1. Federal Law of 12.01.1995 N 5-FZ (as amended on 30.10.2017) "On Veterans".
  2. Tax Code of the Russian Federation.
  3. Law of the Russian Federation of February 12, 1993 N 4468-I "On the pension provision of persons who did military service ...".

No changes were made to the procedure and nature of their provision in 2019, which means that the “preferential” set will remain unchanged. Only EDV, which veterans can receive instead of the social package, will traditionally be subject to indexation by a total of 4%.

Despite the fact that the decisions of the Constitutional Court of the Russian Federation are not legal acts, today one of them - the Resolution of the Constitutional Court of the Russian Federation of April 13, 2016 N 11-P - still regulates the procedure for granting tax benefits. According to his position:

Monthly payments to war veterans should not be subject to personal income tax!

The tax legislation has not yet been brought in line with this decision of the Constitutional Court, but its norms, recognized as unconstitutional, cannot be applied. It is expected that in 2018 the corresponding changes will still be made to the Tax Code.

In the regions, at the level of local legislation, additional preferences may be introduced. More details about what regional benefits are currently in effect and whether they will be valid next year, we will consider in a separate section below.

Pension benefits

They manifest themselves in:

  1. Increased (compared to a regular pension) amount. For each veteran, it is calculated individually and will depend on:
    • Work experience;
    • Areas of war;
    • The presence of injuries, disability.

    On average in Russia in 2017 it is 22,000 - 30,000 rubles.

  2. Supplement to the basic part of the veteran's pension in the amount of 32%. In some regions, there are special multiplying coefficients, so the pension becomes even larger.
  3. Receiving a one-time cash aid (LTA). Its size, while maintaining the NSO is in 2017 - 1731.76 rubles, if the NSO is abandoned - 2780.74 rubles.

Housing benefits

War veterans can qualify for housing improvements by obtaining a housing certificate.

Previously, until 2005, housing was allocated from the housing stock of the municipality. Now this benefit is enshrined at the federal level, therefore the provision of this type of assistance is sponsored from the state budget, and WBD receive cash certificates instead of housing in kind.

To take advantage of the benefit, you must meet two criteria:

  1. Go through the procedure for obtaining a WBD certificate in order to be able to document your status.
  2. Correspond to the parameter of "need", that is:
    • Do not own real estate objects;
    • Own real estate that does not meet residential standards;
    • To live in a premises under a social rent agreement that does not meet residential standards.

A step-by-step algorithm will help you figure out how to take advantage of the housing benefit.

STEP 1. We apply to the housing department of the local administration for registration with an application. How to compose it - you can see hereor ask the administration staff.

We attach the following documents to the application:

  • Original and copy of the passport of the WBD and all family members (for children - birth certificates);
  • Original and copy of the WBD certificate;
  • EHNR certificate (extract from Rosreestr);
  • Extract from home books;
  • Housing documents (if the property has real estate, but it does not meet the standards);
  • The conclusion of the interdepartmental commission / court decision, by which the housing is recognized as unfit for habitation (if in an emergency / dilapidated house)
  • Social rent agreement (if the applicant is a tenant);
  • Marriage or divorce certificate;
  • A copy of the personal account;
  • Original and copy of SNILS of the applicant and family members.

After verification with copies, the original documents are returned.

STEP 2. We expect a response from the administration within 30 days from the date of application. If you have received a refusal to register, you can appeal it in court within 3 years from the date of receipt of the notification.

STEP 3. Follow the progress of the queue. Since the queue is all-Russian, the application is assigned two numbers: one for the all-Russian queue, the second for the regional one. Using them, you can monitor the speed of the queue - this data should be publicly available on the administration website.

STEP 4. After the receipt of funds from the state budget to the regional and the onset of the applicant's turn, the administration notifies him of this. Within six months from this moment, the war veteran must use the certificate - find suitable housing and conclude a sale and purchase agreement.

The certificate is not issued to the hands, but is provided to the seller of the property when the transaction is made. You cannot cash out the certificate in any way.

STEP 5. After the conclusion of the transaction, it is necessary to register the ownership of the acquired real estate in Rosreestr. You can make a personal visit to the service, use the online registration service on the official website, or entrust this matter to a representative.

The social norm of the total area of \u200b\u200bthe dwelling is set at 33 sq. meters - for single citizens, 42 sq. meters - for a family of 2 people and 18 sq. meters for each family member with a family size of 3 people or more. Officers with the rank of colonel and above, as well as those with a scientific degree, are entitled to 15 additional meters.

WBD is given the right to choose in the acquisition of housing: he can buy an apartment in a new building, and a "secondary housing", and even more - to purchase an object at the construction stage.

The certificate is issued for a certain amount. If it is not enough to pay for the housing you like, the war veteran can pay the difference from his own funds. In turn, if the cost of the apartment is less, the balance will be returned to the budget after payment.

Example # 1... Savchenko L.L. is a WBD and lives in St. Petersburg with his wife. He turned to the housing department to get registered. When submitting an application, I asked the employees how much the certificate was entitled to. The average market value of a square meter of housing in St. Petersburg is 62,228 rubles, which means that the size of the certificate will be:

Benefits for housing and communal services

At the federal level, communal benefits for war veterans are provided in the form of:

  • Compensation in the amount of 50% for the payment of rent (for both owners and tenants under a lease agreement);
  • Compensation in the amount of 50% for the payment of the overhaul fee (but not more than 50% of the amount of the fee).

Compensation is a return of funds already paid for a communal apartment, and this is its main difference from a subsidy, which is paid before the bills have to be paid.

The amount of 50% of the monthly rent goes to the account indicated by the veteran.

notethat benefits for paying bills for electricity, water, gas for WBD are not introduced by federal legislation! However, they can be additionally introduced by regional authorities, so their effect does not apply to all regions of the Russian Federation.

Tax incentives

There are a number of tax incentives for WBD. Let's consider each of them in detail.

Personal income tax

According to clause 1 of clause 2 of Art. 218 Tax Code, when calculating the income tax of a veteran of military operations, a tax deduction of 500 rubles is applied for each tax period.

You can take advantage of this benefit in 2 ways:

  1. Directly at work, then the tax will be withheld monthly in a smaller amount;
  2. At the tax office at the end of the year, then the overpaid money for the whole year will be returned to you.

This tax deduction applies to all types of income:

  • Salary;
  • Income from the sale of property (apartment, car);
  • Income from renting out property;
  • Income from a work contract, etc.

Example No. 2... Zubchenko I.G. is not a combat veteran. Despite the fact that he meets the criteria for this category, he did not properly issue the WBD certificate. His salary is 40,000 rubles. The income tax rate is 13%. He pays monthly tax in the amount of 40,000 X 13% \u003d 5,200 rubles.

If he receives this certificate, then after contacting the tax office with the necessary documents and submitting a corresponding application to the employer, the accounting department will apply a tax deduction of 500 rubles when calculating the tax:

(40,000 - 500) * 13% \u003d 5135 (p).

The savings will amount to 65 rubles per month, and 780 rubles per year.

War veterans who have received disability groups 1,2,3 while performing combat missions enjoy an increased tax deduction of 3,000 rubles.

Please note that social benefits paid to this category of persons are not subject to personal income tax. This position was taken by the Constitutional Court of the Russian Federation in its Resolution of April 13, 2016 N 11-P.

Transport tax

At the federal level, there are no transport tax benefits for war veterans.However, the regional law can introduce them - the benefits are valid within the region of residence of the veteran (the place of registration of the transport does not matter).

Property tax

    • Upon reaching the age limit;

    • In connection with organizational and staff activities.
  2. Soldiers-internationalists who were dismissed from military service or called up for military training, who performed their duty in countries where hostilities were fought.

The benefit can be used in relation to:

  • Apartments, rooms in it or a communal apartment;
  • Houses;
  • Commercial premises used in professional creative activities;
  • Buildings (no more than 50 sq m) located on plots for maintaining ancillary personal, dacha farming, truck farming, etc.
  • Garage.

Only one property is not taxed. If a veteran has several of them, he has the right to choose for himself which of them to use the tax credit.

Land tax

WBD are not fully exempt from land tax. They can take advantage of a tax deduction of 10,000 rubles. It is by this amount that the cadastral value of the site is reduced before starting the calculation of the tax amount.

Example No. 3... V. I. Kupriyanova owns a land plot in Moscow, the cadastral value of which is 47,000 rubles. The land tax rate is 0.3%. The amount of tax that she will have to pay:

(47,000 - 10,000) * 0.3% \u003d 111 (p)

You can take advantage of the privilege only if you pay tax for 1 site within the same region. But at the same time, if there are several plots, and they are located in different regions, you can use the privilege in relation to one plot for each region.

Example No. 4... V. I. Kupriyanova owns one land plot in Moscow, the second in St. Petersburg. The cost of one of them is 120,500 rubles, the second - 136,000 rubles. Let's calculate the tax, taking into account the deduction:

If the cadastral value of the land is less than 10,000 r, the land tax is not levied on the WBD.

State duty relief

When applying for the protection of his rights, enshrined in the Federal Law "On Veterans", to a magistrate or to a civil court, a veteran of military operations is exempt from paying state duty.

Exceptions are claims with a declared price of more than RUB 1 million. Then the state duty is paid, but at a reduced rate. The amount is calculated according to the following formula: 13,200 rubles plus 0.5 percent of the amount exceeding 1,000,000 rubles, minus the amount of the state fee payable at the price of the claim of 1,000,000 rubles.

Other federal benefits

In addition to the benefits listed above, combat veterans are entitled to:

  • Installing a telephone in an apartment without waiting in line;
  • Free prosthetics (money is returned later in the form of compensation);
  • Purchase of tickets for any transport without queuing;
  • Preferential use of all types of services of communication institutions, cultural and educational and sports and health institutions;
  • Training by profession at the expense of the employer.

  • Using annual leave at a convenient time for them and providing free leave for up to 35 calendar days a year;
  • Priority in joining housing, housing construction, garage cooperatives, horticultural, horticultural and dacha non-profit associations of citizens;
  • Training by profession at the expense of the employer;
  • Provision of housing in case of eviction from the office premises occupied by them.
  • Persons who went to work in Afghanistan in the period from December 1979 to December 1989, who worked the deadline for the direction or were seconded ahead of schedule for valid reasons.
  • Persons who were sent to work to ensure the performance of special tasks in the territory of the Syrian Arab Republic from September 30, 2015, who worked the deadline set for the direction or were seconded ahead of schedule for valid reasons
  • Preferential provision of vouchers to health resort organizations;
  • Using the annual leave at a convenient time for them;
  • Advantage for admission to horticultural, horticultural and dacha non-profit associations of citizens;
  • Installation of an apartment telephone without a queue.

In addition, each veteran can use a set of social services (NSO), which includes:

  • Free provision of medicines and products (by prescription);
  • The right of free travel to the place of treatment and back on passenger transport of suburban and intercity communication;
  • Providing sanatorium treatment if necessary.

NSOs can be waived until October 30 of each year. Then it will be replaced with a monthly payment in an amount increased accordingly by the cost of the NSO, which the recipient refused.

What is the difference between a combatant and a veteran

The concepts of "participant" and "veteran" are not legally defined.

However, Article 3 of the Federal Law "On Veterans" lists those persons who are combat veterans:

  1. Servicemen in automobile battalions and military personnel of flight personnel on the territory of Afghanistan during the period when hostilities were conducted there;
  2. Sent to work in Afghanistan from December 1979 to December 1989;
  3. Employees in the Syrian Arab Republic since September 30, 2015;
  4. Demining the territory of the USSR and adjacent states in the period from 1945 to 1951;
  5. Engaged in combat trawling operations from 1945 to 1957;
  6. Carried out official duties during the hostilities on the territory of the Russian Federation, the USSR, as well as other states
    • Algeria;
    • Egypt;
    • Angola;
    • People's Republic of Yemen;
    • Vietnam;
    • Syria;
    • Ethiopia;
    • Afghanistan;
    • Cambodia;
    • Mozambique;
    • Laos;
    • Bangladesh;
    • Lebanon;
    • Tajikistan;
    • Chechnya;
    • North Caucasian region;
    • South Ossetia and Abkhazia.

Thus, the participants in the hostilities in Afghanistan and the hostilities in Chechnya are labor veterans.

If a veteran wants to take advantage of the benefits, then his status must be confirmed by the appropriate certificate... If there is none, you will have to go through the procedure to obtain it.

Benefits to combatants are allowed only if they received a veteran's certificate in accordance with the procedure approved by order of the Russian Ministry of Defense No. 2288 dated August 11, 2012. Then they will enjoy the benefits of a combat veteran. Federal legislation does not provide for a separate category of benefits for “participants”.

Are benefits to family members of veterans

Some benefits also apply to family members of veterans. For instance:

  1. Children of veterans can visit children's health camps once a year at half price.
  2. The child is assigned free two meals a day.

In addition, the family of a deceased / deceased veteran has the right to use all of his benefits, if they were supported by him. Children are automatically considered dependents, but the widow will have to collect a package of documents to prove this fact.

Pension payments to veterans of Chechnya
