For 2014, the estimated working time was established by the resolution of the Ministry of Labor and Social Protection of the Republic of Belarus No. 95 dated September 13, 2013 (hereinafter - Resolution No. 95), according to which, at the full standard of working hours (40 hours per week), the estimated working time per The year 2014 will be 2,015 hours for a 5-day working week with days off on Saturday and Sunday, 2,017 hours for a 6-day working week with days off on Sunday.

The published production calendar for 2014 provides the estimated working time for each month of the year with a full working time of 40 hours per week (Article 112 of the Labor Code) and with a reduced working time of 35 hours per week established for certain categories of workers (Article 113 and 114 TC), taking into account weekends: Saturday and Sunday for a 5-day work week and Sunday for a 6-day work week.

It should be noted that the religious holiday Easter, according to Decree No. 157, both according to the calendar of the Orthodox confession and according to the Catholic calendar, is not declared a non-working day, and the day of celebration constantly falls on Sunday. Consequently, for workers whose working hours are determined by the work schedule (shift) and the working time (shift) falls on Sunday (Easter holiday), payment for work on the specified day is made in the usual manner, i.e., as for work on a working day. day. When attracting workers for whom, according to the established working hours, Easter is a day off, compensation for work on that day is made in accordance with the norms of Article 146 of the Labor Code.

When determining the calculated norm of working time, it was also taken into account that the duration of work on the working day immediately preceding the holiday is reduced by one hour. For both 5-day and 6-day workweeks, March 7, April 28, April 30, May 8, July 2, November 6, December 24, and December 31 are all business holidays.

According to Art. 116 of the Labor Code, the duration of the working time of employees on the working day immediately preceding a public holiday or a holiday declared non-working by the said Decree shall be reduced by 1 hour. Due to the fact that March 8 coincides with the first Saturday of the month, the number of holidays with a 5-day working week will be 8 days, and with a 6-day working week - 9 days. In this regard, the estimated working time in March, May, July, November with a 5-day and 6-day working week is also reduced by 1 hour, and in April and December by 2 hours.

In 2014, with a standard working time of 40 hours per week, its average monthly calculated rate for a 5-day working week is 167.9 hours, for a 6-day working week - 168.1 hours, and over the past ten years for a 5-day and For a 6-day work week, the estimated rate will be 168.9 hours.

From May 1 to May 4 (as you remember, May 2 became a day off thanks to the January Saturday), the weekend is provided in connection with Spring and Labor Day, so there will be only three business days per week. And next week on Friday the whole country will celebrate Victory Day - we will rest for three days, until Monday.

Summer and November holidays

Public holidays this year are also pretty good. In the summer we are waiting for the Day of Russia, which will give four days off at once - from June 12 to 15, inclusive, and in the fall - National Unity Day, and four more days off - from November 1 to 4.

Note that in 2014 not a single regular weekend will suffer from the postponement of the holidays. You can devote all Saturdays and all Sundays to yourself and your loved ones.

The Labor Code of the Russian Federation established that if a day off and a non-working holiday coincide, the day off is transferred to the next working day after the holiday. The exception is weekends that coincide with non-working holidays in January. Changes made to Art. 112 of the Labor Code of the Russian Federation Federal Law of 23.04.2012 N 35-FZ provides that the Government of the Russian Federation has the right to postpone two days off from the number of days off, coinciding with non-working January holidays, to other days in the next calendar year.

In accordance with part five of Art. 112 of the Labor Code of the Russian Federation for the purpose of rational use of weekends and non-working holidays by employees, weekends may be postponed to other days by the Government of the Russian Federation. At the same time, the procedure for transferring weekends is clearly regulated. It has been established that the regulatory legal act of the Government of the Russian Federation on the transfer of days off to other days in the next calendar year is subject to official publication no later than one month before the onset of the corresponding calendar year. The adoption of normative legal acts on the transfer of days off to other days during a calendar year is allowed subject to the official publication of these acts not later than two months before the calendar date of the established day off.

Decree of the Government of the Russian Federation of May 28, 2013 N 444 "On the transfer of weekends in 2014" due to the coincidence of public holidays on January 4 and 5 with Saturday and Sunday, and February 23 with Sunday, provides for the transfer of days off from Saturday January 4 to Friday 2 May, Sunday 5 January to Friday 13 June and Monday 24 February to Monday 3 November.

Thus, taking into account the transfer of weekends in 2014, the period of the New Year's holidays for employees will be 8 days - from January 1 to January 8, 2014. In May 2014, the duration of the rest of employees associated with the Spring and Labor Day will be 4 days - from 1 on May 4, and the rest periods associated with the celebration of Victory Day will be 3 days - from May 9 to 11, and the Day of National Unity - 4 days (from November 1 to 4). In this case, the norm of Art. 110 of the Labor Code of the Russian Federation, according to which the duration of weekly uninterrupted rest should not be less than 42 hours.

Federal Law of July 22, 2008 N 157-FZ, article 91 of the Labor Code of the Russian Federation was supplemented by part three of the following content:

"The procedure for calculating the norm of working time for certain calendar periods (month, quarter, year), depending on the established working time per week, is determined by the federal executive body responsible for the development of state policy and legal regulation in the field of labor."

Currently, the Procedure for calculating the norm of working time for certain calendar periods of time (month, quarter, year), depending on the established duration of working hours per week, is in force, approved by order of the Ministry of Health and Social Development of Russia dated August 13, 2009 N 588n.

In accordance with this Procedure, this rate is calculated according to the estimated schedule of a five-day working week with two days off on Saturday and Sunday, based on the duration of daily work (shift), for example, with a 40-hour work week - 8 hours, with a working week of 36 hours it will be 7.2 hours; with a 24-hour work week - 4.8 hours.

The duration of a working day or shift immediately preceding a non-working holiday shall be reduced by one hour. In 2014, these pre-holiday working days are March 7, April 30, May 8, June 11 and December 31. The duration of work on Monday 24 February is also reduced by one hour, since according to the current Procedure, in cases where, in accordance with the decree of the Government of the Russian Federation, a day off is transferred to a working day, the duration of work on that day (former day off) must correspond to the length of the working day, to which the day off was postponed (in this case, November 3 was a pre-holiday day).

The working time norm calculated in the indicated order applies to all modes of work and rest.

For example, in January 2014, with a five-day work week with two days off, there would be 17 working days and 14 days off.

The working time this month will be:

with a 40-hour work week - 136 hours

(8 hours x 17 days);

with a 36-hour work week - 122.4 hours

(7.2 hours x 17 days);

with a 24-hour work week - 81.6 hours

(4.8 hours x 17 days).

In 2014, with a five-day working week with two days off, there will be 247 working days, including 6 working days shortened by one hour, as indicated above, and 118 weekends and non-working holidays.

Working hours in 2014 will be:
