Where to rest for a Muslim family in July. Living in infidel countries and refusing to move to any of the Muslim countries for the sake of preserving their religion. Quran and Noble Sunnah about rent

The very word "hijra" (resettlement) has just such a meaning, and for this purpose it is obligatory for a Muslim. If a Muslim continues to live in the land of the infidels, then this indicates his friendly ties with them, and therefore Allah forbade Muslims to live among the infidels if they are able to make the resettlement (hijra). Allah Almighty said: "To those whom the angels restrain from doing injustice to themselves, they will say:" In what position were you? " They will say, "We were weak on earth." They will say: "Was the land of Allah not vast for you to settle on it?" Hell will be their abode. How bad is this arrival place! This does not apply only to those weak men, women and children who cannot contrive and do not find a way out. Allah can forgive such people, because Allah is Forgiving, Forgiving! " (an-Nisa 4: 97-99).

Allah will not accept the excuse of those who lived in the countries of the unbelievers, except those who were not able to do the hijra, as well as those whose stay there benefits the religion, such as calling people to Allah and spreading Islam among the unbelievers. *

*[Note]: The Sheikh's words that it is necessary to move from the land of the infidels to the Muslim countries, if there is such an opportunity, is the basis. The Messenger of Allah (peace and blessings of Allaah be upon him) said: "I have nothing to do with every Muslim who lives among the polytheists" ... at-Tirmidhi 1604, Abu Dawud 2645. Sheikh al-Albani called the hadith authentic.

Also, the Messenger of Allah (peace and blessings of Allah be upon him) said: "Allah Almighty and Great will not accept his deeds from a polytheist who converted to Islam until he leaves the polytheists and migrates to Muslims." ... al-Nasai 5/83, Ibn Majah 2536. Sheikh al-Albani called the hadith good.

Imam al-Sindi (may Allah have mercy on him) said: “Hijra (resettlement) from the land of polytheists to the lands of Muslims is obligatory for everyone who believes. And the one who does not do this is a disobedient person who deserves that Allah does not accept his deeds! " See “Hashiya‘ ala Sunani-Nnasai ”6/83.

Hijra in Islam occupies an important place, and there are many benefits in it, in which, among other things: “a decrease in the number of infidels and an increase in the number of Muslims; helping Muslims against enemies; keeping your faith from temptation; not contemplation of openly committed vices and debauchery in the lands of the infidels, and much more. " See “Silsilyatul-manakhiy ash-shar'iya” 3/217.

The hijra from the country of infidels to the country of Muslims is basically obligatory, but if a Muslim living in the land of infidels, without fear for his religion and himself, can openly practice Islam, without fear for his religion and himself, then for him the hijra becomes desirable, but not required. Otherwise, a person who does not perform the hijrah, while he has the opportunity to do so, falls under the threats that Allah said in the Qur'an. Hafiz Ibn Kathir (may Allah have mercy on him) said: "Scientists are unanimous that those who fear for their religion and have the opportunity to resettle must do so."... See “Tafsir Ibn Kathir” 2/389.

Al-Nawawi wrote: "A Muslim who is in a weak position in the land of the infidels (Darul-Kufr) and who does not have the opportunity to openly practice his religion in it, is prohibited from living in this country, and he is obliged to perform Hijra in an Islamic country (Darul-Islam)." See Raudatu-ttalibin 10/282.

However, many Muslims believe that openly practicing their religion consists only in performing religious rituals like prayer, fasting, visiting a mosque, wearing a beard, headscarves, etc. In fact, the concept of "open confession of religion" (izharu-ddin) carries a broader meaning, and this includes, first of all, the fact that a Muslim can openly speak about the true beliefs of Islam, that the disbelief of the infidels is a delusion, that the truth - this is only Islam. See ad-Duraru-ssaniya 7 / 136-141 and ar-Rasail wa masail an-Najdiya 3/30.

Allah Almighty said about this: “Say (Muhammad):“ O you disbelievers! I do not worship that which you worship, and you do not worship the one whom I worship ”” (al-Kafirun 109: 1-3).

Sheikh ‘Abdur-Rahman al-Sa’di said that if a Muslim is able to openly pray, fast, but is unable to openly manifest his monotheism, iman and‘ aqidu, then he is one who is unable to openly manifest his religion. He said that the land of the infidels is of two types: one that fights and oppresses Muslims, and one that does not fight and which is safe for Muslims. An indication of this is that the Prophet (peace and blessings of Allaah be upon him) allowed his companions to move from Mecca, which was a land of oppression and temptation for Muslims, to the land of Ethiopia, despite the fact that it was also a land of unbelief. However, this land was safe, and it was much quieter than the land of temptation and turmoil, and for this reason the Companions could openly practice their religion there. But the Companions did not speak openly about the error of Christians until the Quraysh informed the ruler of Ethiopia that they were saying about ‘Isa, that he is not God, but a slave and messenger of Allah. And only when Najasha, the ruler of Ethiopia, called the Muslims who had settled on his land, and asked about it, they answered as it is, without distorting the truth that ‘Isa is the messenger and slave of Allah. See “al-Majmu'a al-Kamil” 7 / 68-69, abbreviated.

Based on the foregoing, it becomes clear that the basis of Islam is that a Muslim must openly manifest his religion, both its rituals (prayer, fasting, etc.), and the very doctrine of Islam (like monotheism, hatred of polytheism and infidel ). A Muslim is not obliged to publicly declare the delusion of the unbelievers if the unbelievers already know that this Muslim has such a conviction. But if asked about it, he must say it. All of the above disappears from him only in the absence of the ability. However, in our time, many infidels do not know the true attitude of Islam to their unbelief and false ideologies. And how will they know if the idea is spread among Muslims that it is necessary to unite all divine religions, and this is Islam, Christianity and Judaism ?! And this is despite the fact that Christians do not consider Islam, Judaism or any other religion to be true, just as the Jews do not consider either Islam, Christianity, or any other religion to be true!

As for the very life in the countries of the infidels, then it carries with it enormous harm and temptation for the religion of Muslims. Sheikh Ibn ‘Uzaimin (may Allah have mercy on him) said: “Living in infidel countries contains a great danger for the religion, customs and behavior of Muslims! We saw changes in many of those who lived in these countries, we saw how they returned not the way they left there. They returned as wicked, and some even returned as apostates and unbelievers who mocked religion and Muslims, may Allah save us from this! ” See “Majmu'u fataua” No. 388.

The scholars of the Standing Committee (al-Lajnatu-ddayim) were asked: "Is the hijra allowed to the land of the infidels for work?" They have replyed: “If you want work and earnings, then go to the country of Muslims for this. The countries of the Muslims are richer than the countries of the infidels due to the fact that when traveling to the countries of the infidels there is a danger to their beliefs, religion and morals ”... See Fatawa al-Lajna 12/58.

Sheikh Salim al-Hilali said: “I have not seen Muslims weaker by faith (iman) than those of them who lived in the infidel countries!” See "Silsilyatul-manahiy ash-shar'iya" 3/218.

However, today you can hear how some Muslims, in response to the arguments about the importance of the hijra, say: "Nowadays it is impossible and there is nowhere to do the hijra!" And they declare the same despite the words of Allah Almighty, who says: “O my servants, believers! Indeed, My land is vast, worship Me! "(al-‘Ankabut 29: 56).

Allah Almighty also said: "Whoever migrates on the path of Allah will find many shelters and abundance on earth."(an-Nisa 4: 100).

As for some of the lost, they went even further and called such a great prescription of Islam as hijra - cowardice. Holy Allah, how averted they are!

Sheikh Useimin said in a scarh on three bases:

Speaking about resettlement, the author of Al-Mughni classifies people as follows: - For some of them resettlement is mandatory. We are talking about those who can do this and do not have the opportunity to openly practice their religion. Thus, if life among the unbelievers excludes the possibility of a person fulfilling his religious duties, then he should move, for Allah Almighty said: “Those whom the angels will rest by causing injustice to themselves, they will say: 'In what position were you?' They will say: "We were weak on the ground." They will say: 'Was not the land of Allah vast enough for you to settle on it?' Women, 97. This is a serious threat that relocation is imperative, since the fulfillment of religious duties is mandatory for those who can fulfill them. Resettlement, in this case, is a necessary condition for their implementation, and that, without which it is impossible to do something obligatory, is itself obligatory. See: Al-Mughni, vol. 8, p. 457.

If both of the above-mentioned basic conditions are met, then the following possible cases can be indicated:

FIRST CASE: when a Muslim lives in the land of the infidels to carry out the call and instill in people an inclination to Islam. In this case, living there is one of the types of jihad, mandatory for those who are able to carry out it, provided that no one interferes with the implementation of this appeal and the response to this appeal. This type of jihad is obligatory because the call to Islam is one of the religious duties, the messengers of Allah used to go this way, and the Prophet (peace and blessings of Allah be upon him) commanded Muslims to inform other people about it at all times and in any place. saying, "Report me, even if it is limited to one verse."

SECOND CASE: when a Muslim lives in the land of the unbelievers in order to study their position and familiarize themselves with their vicious views, invalid forms of worship, moral corruption and the permissiveness prevailing among them, in order to then warn people about the danger of being seduced by them and explain to those who admire them the true essence of their situation. In this case, living like this is also a type of jihad, since it is associated with warning Muslims against unbelief and unbelievers and implies an incentive to Islam and its leadership, since the viciousness of unbelief in itself indicates the good of Islam, which confirms the correctness of the statements that that everything is cognized through its opposite. However, at the same time, he must carry out his task in such a way that this does not lead to something even more pernicious. So, for example, if a person cannot achieve his goal for the reason that he will be prevented from spreading information about the situation of the unbelievers and warning others against it, then there will be no benefit to him being there. In the same way, we can say that if he fulfills his task, but this leads to an aggravation of the situation, for example, if his actions lead to the fact that people begin to revile Islam, the messenger of Islam and the imams of Islam, then such activities will have to be stopped, for Allah Almighty said: “Do not blaspheme those to whom they cry besides Allah, otherwise they will blame Allah out of hostility, not possessing knowledge. Thus, We have adorned all people with their deeds! Then there will be a return to their Lord, and He will inform them of what they were doing. " "Cattle", 108.

Similar to this is the case when a Muslim lives in a country of infidels in order to be a spy on Muslims, to learn about the intrigues planned against them, and to warn them about it. For example, it is known that at one time, namely, before the battle at the moat, the Prophet (peace and blessings of Allaah be upon him) sent Khuzaif bin al-Yaman to the polytheists so that he would find out everything he could about them.

THIRD CASE: when a Muslim lives in the country of the infidels in the interests of the Muslim state in order to establish its relations with the country of the infidels, which applies, for example, to the employees of the embassies. Thus, the cultural attaché is there to observe the situation of students and encourage them to adhere to the religion of Islam and adhere to Islamic moral principles, thereby achieving great benefits and eliminating great evils.

FOURTH CASE: when a Muslim lives in a country of infidels because of the need to do something that is permissible, for example, for trade or medical treatment. In this case, the presence of the infidels in the country is permissible as necessary, for the permissibility of visiting infidel countries for trade was indicated by those with knowledge, may Allah have mercy on them, who referred to the words of some of the Companions of the Prophet (peace and blessings of Allaah be upon him) may Allah be pleased with them.

FIFTH CASE: when a Muslim lives in a country of infidels for the purpose of getting an education. This case is similar to the previous one, however, in this case, the Muslim faces greater dangers for his religion and his morality than when he is engaged in commercial affairs, for he feels the superiority of his teachers over himself, and this leads to the fact that he begins to revere them. agree with and imitate their views, ideas and ways of acting, which happens to everyone except those who are fortunate enough to protect themselves from it by the will of Allah, but there are not many of them. In addition, the student feels the need for his teacher, and this leads to the fact that he begins to seek his favor and curry favor with him, despite all his deviations and delusions. In addition, any student has fellow practitioners, from among whom he chooses friends for himself, starting to love them, seeking closeness with them and adopting something from them. Given the danger of all this, a Muslim needs to be more careful than in previous cases, and therefore, along with the two above-mentioned basic requirements, he must also comply with a number of additional requirements:

FIRST: the student should be distinguished by great mental maturity, with the help of which he could distinguish between useful and harmful and anticipate events. As for the sending of young adolescents and those who have not yet reached the necessary mental maturity to school, this poses a huge danger not only to their religion and morality, but also to their people, for when they return back, they will spread around themselves the poison that will inevitably be taken from the infidels, which has been repeatedly confirmed and will continue to be confirmed by real facts. So, for example, many of those who were sent there to study immature, returned back, having lost even that little that they had before, and deviated from their religion and moral foundations, which brought them and the society to which they belonged alone. only obvious harm. Thus, sending immature people to study with the unfaithful is like giving up sheep to be torn apart by predators.

SECOND: a person who acquires knowledge from the unbelievers must be knowledgeable in the field of Sharia so that this allows him to distinguish true from false and fight falsehood with the help of truth. This is necessary in order not to succumb to the deception of the false that the unbelievers adhere to, and not to take it for the truth, or not to be confused in this or not to be weak enough to not be able to resist it, as a result of which a person falls into confusion or he himself begins to follow the false.

It is reported that the Prophet (peace and blessings of Allaah be upon him) appealed to Allah with the following prayer: “O God, make the true appear before me in its true light, and give me the strength to follow it, and make the false appear before me. me also in the true light, and give me the strength to move away from him, and do not make it obscure to me, so that I do not fall into error! "

THIRD: the student of the unbelievers must adhere to his religion so firmly that it can protect and keep him from unbelief and deviations, since a person who does not adhere firmly to the principles of his religion cannot be saved from all this, living among the unbelievers, only if it is pleasing To Allah, for the attacker in this case will be strong, and the one who resists will be weak. It is well known that in the lands of the unbelievers there are many things that persistently induce people to unbelief, and therefore, if resistance is weak, all these factors immediately begin to exert their influence.

FOURTH: the need for that knowledge for the sake of which a Muslim lives in the land of the infidels, the usefulness of what he studies for Muslims and the lack of the possibility of acquiring such knowledge in the countries of Islam. If such knowledge is superfluous and will not bring Muslims any benefit, or if the same can be learned in any of the Muslim countries, then the stay in the country of the infidels for the purpose of teaching becomes impermissible for the Muslim because of the danger it poses to his religion. and morality, and the useless waste of large material resources associated with this stay.

SIXTH CASE: when a Muslim moves to the country of the infidels for permanent residence. Likewise, it is the most dangerous of all of the above and entails constant communication with the unbelievers and makes a person feel like a citizen of this or that country, obliged to love what others love and seek closeness to it. In addition, among the infidels there are also members of his family who begin to adopt the customs and customs of the infidels and may even accept their views and forms of worship, and that is why the Prophet (peace and blessings of Allaah be upon him), as reported in one of the hadiths, said: “ The one who unites with the polytheist and lives with him becomes like him. "

There is another hadith, transmitted from the words of Qais bin Abu Hazim, who referred to the reports of Jareer bin Abdullah (may Allah be pleased with him) that once the Prophet (peace and blessings of Allaah be upon him) said: “I have nothing to do with any of those Muslims who live among polytheists. " He was asked: "Why, O Messenger of Allah?" He said, "None of them should see the fire of the other." So can the soul of that Muslim who lives in the land of the unbelievers, where their rituals are openly performed and where the decision belongs not to Allah and not His Messenger, can come to good, if he sees it, hears it and agrees with it, and, moreover, belongs to to this country and lives in it with his family and children, despite the great danger that all this poses for his religion ?! This is what we can say about the stay of a Muslim in the land of the unbelievers, and we ask Allah that our words do not contradict the truth and do not contradict common sense. Source of comments on the book "Three Foundations". [End of note].

For most of their history, Muslims have lived under the shadow of an Islamic state and in an Islamic society. Almost all of the classical Islamic legal and cultural heritage was formed precisely during this period - the residence of Muslims on their own Muslim territory.

However, over time, as the Muslims themselves and Islamic civilization weakened, the Islamic state began to crumble, and more and more Islamic lands began to move away from the Caliphate under the rule of non-Muslims. At that time, in the minds of Muslims, the conquered territories could not keep within that they would live under the rule of unfaithful rulers. That is why they performed hijra en masse from the lands occupied by non-Muslims to those countries where Muslim rule was still preserved. Thus, the Muslims almost completely abandoned Andalusia and Sicily, which had been recaptured from them.

Similarly, from the Caucasus and Central Asia conquered by Tsarist Russia, Muslims in whole villages and auls left and performed hijra to Turkey, Arabia and Afghanistan. However, this time they did not leave completely. Most of the Caucasian highlanders, Uzbeks and Tajiks decided to remain under the rule of the "white king". And not so much because their faith turned out to be weaker than that of the non-Muslims Muhajirs who were leaving the rule. But also because by that time in many Muslim lands they were not ready to welcome them cordially and hospitably, as the Ansaras of Medina greeted the muhajirs of Mecca. And the lands they, often, stood out even worse than in their own scorched rocks, gorges and deserts.

In the same way, the Tatars, Bashkirs, Balkan Muslims, and then the inhabitants of all lands occupied by the Western colonialists - India, Egypt, Algeria, Libya, etc., decided to remain under the rule of non-Muslims. By the time the countries of the Arab East were colonized by the West, there was practically nowhere for Muslims to perform hijra. By this time, the level of development and living conditions in Muslim countries had reached such a low level that Muslim lands turned into the most neglected outskirts of civilization.

And suddenly, in the 20th century, the situation changed dramatically. In many Muslim countries, such ferocious dictators have taken hold of power that it has become not only more difficult to live under their thumb and remain faithful to the Islamic religion than under the rule of Western non-Muslim governments, but it is simply impossible. And in the West at this time, the economy was developing rapidly, democracy was strengthening and expanding, human rights were consistently defended, regardless of religious beliefs or national origin.

And Muslims suddenly began to voluntarily move to non-Muslim countries in a wide wave, fleeing the persecution of dictators in their own countries. Because there are many more opportunities in the West to preserve their own religious beliefs than in their native places. In addition, Western countries provided the broadest opportunities for earnings and education. The same picture, with some differences, developed in the expanses of the former USSR, when the Muslims of the Caucasus and Central Asia were forced to escape from the repression and poverty of their own republics in Moscow, St. Petersburg and other cities and regions of Central Russia.

But the outcome in the West and in Russia turned out to be the same. A huge mass of observant Muslims found themselves living not only in the absence of Islamic rule, but also surrounded by non-Muslim peoples and societies. In such conditions, in which Muslims have never lived in history, they faced a huge number of questions and urgent problems. The main question facing Muslims living in non-Muslim societies to this day is the question of what should be the intentions and goals of believers who settled down for permanent residence in such conditions?

Of course, the first duty of any Muslim, regardless of where he lives, is to elevate the word of Allah above all else. What does it mean to convey to the people of the Islamic call, the development of an Islamic society, strengthening and rallying the ranks of believers and the establishment of justice in this world. Living in non-Muslim societies not only does not relieve a Muslim of these duties, but also increases his responsibility for fulfilling them somewhat. And the non-Muslim society itself forces the Muslim to devote more attention and zeal to those goals and objectives, without which his main mission is absolutely impossible.

It is quite obvious that if we are talking about convinced and observant Muslims, and not about those who have forgotten and abandoned their religion, then the very first goal of any Muslim at any time and in any place should be to preserve and strengthen his faith. This goal is achieved by firm adherence to Islamic precepts, striving to observe as much of additional worship as possible, reading Islamic literature, communicating with righteous and God-fearing brothers, visiting the mosque as often as possible, and deepening Islamic knowledge.

The next duty of a Muslim is to show the broadest concern for his family, since surrounded by unbelievers, the Muslim family is the most basic fortress and citadel. Taking care of the family means not only providing it materially, but also taking care of its moral health, the depth of faith, the level of fear of God, and the degree of adherence to Islamic precepts.

While caring for one's family is already the responsibility of every Muslim, its importance should be emphasized in the case of Muslims living in non-Muslim societies. In traditional Muslim countries, the Muslim society itself, the circle of close relatives, friends and neighbors greatly helps to solve the problems associated with the proper upbringing of children and youth, the creation of a Muslim circle of communication for women. In non-Muslim societies, however, most often there is no one to take on this range of responsibilities, since Muslim communities are just being formed there. Therefore, a Muslim, as the head of the family, has to approach this responsibility with a double responsibility.

The next duty of a Muslim is to join forces with his fellow believers. Again, in a non-Muslim society, the importance of this step increases significantly. To resist the onslaught of temptations, factors that distract and destroy faith, Muslims must not only unite, but also unite as one person. Speaking about the degree of unification, interaction and mutual support of Muslims, the Prophet (peace and blessings be upon him) said: "A believer is like a structure for the believer, each stone of which holds another."

The duty of Muslims to the society where they live, in order to give this society true knowledge and bring it out of error, is also one of the fundamental ones. Muslims should remember that Islamic calling is not only the responsibility of imams, scholars and sheikhs, but the responsibility of every observant Muslim. A Muslim living in a non-Muslim society not only should not reduce his zeal for the call to Islam, but also pay much more attention to him than his brothers in Muslim countries. Since he, unlike them, is on the forefront of opposition to atheism and unbelief, brings the light of Islam to lost people and gives them the opportunity to gain the mercy of Allah.

Another step in the duties of a Muslim is the duty to protect the interests and rights of the Muslim Ummah - the oppressed, in need of help, seeking advice and support in trials. Today we all see how the United States or Israel, for the sake of one of its citizens, who is in trouble or a difficult situation in other countries and societies, are ready to mobilize battalions of diplomats, politicians, military, negotiators, etc. Muslims, having so many instructions from the Almighty and His Prophet (peace and blessings be upon him) about the need for help and support of the brothers, need to show ten times more diligence in this direction.

It is on whether Muslims pay due attention to all their duties, fulfill their best duties and show sincere diligence in this, not only the future of Muslims in non-Muslim societies, but also the future of the entire Islamic civilization depends. And it is we, our generation of Muslims, who have a unique chance to become that Islamic vanguard in the non-Muslim world, which will once again raise the religion of Allah to its due heights.

It often happens that the acquisition of some kind of movable or immovable property for a person or an entire organization is not profitable. Sometimes prices can "bite", in some cases, the purchase of an object does not make sense due to the constant volatility of the market situation. And here such an economic and legal instrument as rent comes to the rescue. Islam, being a system that helps people in all spheres of life, imposes its own framework on this form of property relations between the parties.

In Arabic, rent is denoted by the word "Ijar" , which can be translated as "Sale of the right to use", "benefit". The Shariah definition of this phenomenon is as follows: the conclusion of a transaction between the parties for a certain time regarding some property, aimed at obtaining benefit, on the basis of mutual consent.

In fact, in Islamic law, lease is divided into two types: 1 - lease aimed at obtaining some kind of benefit (we are talking about real estate, vehicles, clothing, household appliances, and so on); 2 - hiring a person to do a certain job (for example, construction, sewing clothes, website development, writing texts, etc.).

Quran and Noble Sunnah about rent

The Holy Qur'an speaks in two places about the lease relationship between the parties, but in these cases the references are episodic.

Surah At-Talak says the following:

"Provide a shelter for divorced women for a specified period ..." (65: 6)

In surah, lease relations are mentioned in the context of the story of the Prophet Musa (a.s.):

“One of Shugaib's daughters said:“ Father, hire him as a shepherd! He will be the best among those who can handle it. " To this Shugaib replied: “I would like you to marry one of my daughters. As a bride price, you can offer me a hired job in my interests for 8 years ... ”(28: 26-27)

In the collection of hadiths of Imam al-Bukhari, one can find the saying of the Final Envoy of the Almighty Muhammad (s.g.v.) about how he told his companions about his past. His labor activity in the form of hiring also did not stand aside: “Whoever is sent by Allah into this world, he still tends sheep. And me too. I did it for the people of Mecca, they paid me several carats for this work. "

Rental conditions in islam

The lease relationship has two fundamental aspects. As in the case, it is about proposal(ijab) and consent(Kabul).

The conditions for concluding a lease agreement boil down to several points:

1) A person must be reasonable, that is, he must be at least 7 years old. At such a young age, he can act as a subject of such property relations only after receiving permission from a guardian.

2) The rented property must have an owner. The lease is not made in relation to those things, the owner or guardian of which is unknown.

3) The agreement must detail the essence of the leased, the time of lease or lease (if we are talking about people invited to carry out some type of work). There should be no understatement between the parties in order to avoid related conflicts.

4) The rented item or service must be such that they really have the properties that the renter expects. In addition, these qualities must comply with Sharia. For example, if the administration of a mosque is looking for a cleaning lady and finds her, then she should be in a clean state at the time of work (no menstruation). Otherwise, she will be prohibited from entering the mosque, and she will not fulfill the terms of the contract of employment.

5) The benefits of renting or hiring must fully comply with Islamic law. In this sense, it is forbidden to hire people to commit any crime or to produce haram products and services.

6) You cannot hire a person if it is assumed that he will perform actions that are obligatory for him, according to Islamic law. For example, taking money for a prayer performed is unacceptable. However, if we are talking about conducting classes, for example, on Islamic law, on the construction of Muslim temples, then this prohibition does not apply.

7) A person who is hired to do some kind of work should not directly benefit from the result of the work, since the latter does not apply to him, but to the employer. Legal scholars interpret this case as the fact that the worker cannot be paid with the result of his work. For example, if a person was to produce wooden figures, then he cannot be paid with the same toys.

8) If the rental object is movable property, then the lessor must provide it to the tenant personally.

9) The object of the lease should not have any flaws that make it impossible to use all the available properties.

Cases of cancellation of lease agreements:

  • in connection with the death of one of the parties to the contractual relationship;
  • if the parties are unanimous in the opinion that it is necessary to terminate the agreement for some reason;
  • if, under certain circumstances, the rented item has lost its essence (for example, it was destroyed);
  • the lease agreements expired and the parties decided not to renew them.

Who Muslims Can't Takeproperty for rent

The lease conditions listed above are distinguished by the fact that their implementation is relatively easy in a homogeneous Islamic environment, where the issue of compliance with Sharia business is not so acute. But what to do when Muslims are forced to enter into business relations in a secular society, in regions where the representatives of Islam do not dominate? What if the tenant is going to open a strip bar, a credit organization or a shop that sells alcoholic beverages in a Muslim-owned building?

The answer to these questions, according to Islamic law, is not as simple as it seems. Pupils and founders of other madhhabs of Sunni Islam believed that leasing property for such purposes was prohibited. Abu Hanifa believed the same, but with some reservations, which will be discussed below. The economic benefit as a criterion in the above situations is completely neglected. Banking institutions, microfinance organizations, which, as a rule, do not have problems with money, can offer an attractive price for the rented area, but a devout Muslim must resist the temptation and refuse such a potential tenant.

The ban also includes classic Western-style insurance companies that deal with uncertainty. What does it mean? Insurers take premiums from the client, the return of which, even in the case of the conditions specified in the contract, may not occur. As a result, a person pays money to the insurer, and he can, thanks to his own legal resourcefulness, do nothing at all and subsequently avoid material payments in favor of the insured. In addition, it is very risky to lease premises for hotels, massage studios, saunas and baths, which in certain areas are often used, in addition to their direct purpose, as a place for committing carnal sin.

It should be noted that the owner of the premises may not be responsible for the actions of the tenant if the latter deliberately misleads the owner of the property. For example, it was initially agreed that in the same massage parlor women would serve exclusively women and vice versa, but in reality it turned out that the tenant arranges a “zina festival” on an ongoing basis - in this case, the owner does not bear any responsibility to the Almighty. The situation is interpreted in a similar way if the store originally agreed to a ban on the sale of alcoholic beverages, but the tenant does not fulfill this clause of the agreement. However, of course, it is better to prevent such a situation and keep the tenant's activities under control for their compliance with the contract.

Imam Abu Hanifa believed that in conditions when a Muslim lives in a country where his fellow believers are a minority, renting premises or some items to open a shop with alcohol is not prohibited. However, doing this in a Muslim country is strictly prohibited.

All reputable scholars are allowed to enter into rental relationships with representatives of other religions, such as Christians or Jews. Imam Abu Hanifa believed that they could even open their own temples and other religious sites in rented premises, while his students and imams of other Sunni madhhabs considered such agreements contrary to Sharia.

People rest in different ways: whether it is active or passive rest, the main thing is that it brings pleasure and gives a surge of strength until the next vacation season.

It is good to have a rest, of course, but it is worth discussing its availability in terms of "halal". It is known that for Muslims there are several requirements for rest: permitted food, a place for prayer, for women - a deserted bathing area, but these are, perhaps, the main ones. It seems that not everything is so bad: as for halal food, I think you can do without meat for several days and eat fish and vegetable dishes, or kosher food, a place for reading namaz is all free space, if only it is clean and in the right direction , and a Muslim woman will be able to swim by looking for a deserted place or in a special bathing suit - "burkini", now they are, fortunately, for every taste and wallet.

And the spirit of the fatherland is sweet and pleasant to us ...

The most popular among Russians, since Soviet times, are the resorts of the Krasnodar Territory: these are the cities of Sochi, Anapa, Gelendzhik. This is explained by the fact that the climate there is subtropical, the sea remains warm for a long time, and small sandy beaches traditionally attract tourists with children, and a passport is not required. This summer I managed to relax in these parts, namely in the city of Adler, I also managed to visit nearby Abkhazia, which met with its famous resorts Pitsunda and Gagra. I will compare all the pros and cons of a Muslim holiday in these regions. In Adler, we rented a room with a bath and a toilet in a huge house, because in the hotel I was not satisfied with the prospect of night festivities and noisy music until the morning, as well as drinking alcoholic beverages from its inhabitants. The sea is two minutes from the house, but the beach is completely strewn with vacationers, and no matter how much we tried to find a secluded place, it did not work out. Resigned, I swam in a special suit. It turned out to be not so bad! The suit dries easily, lets in the sun's rays, and most importantly, there are no sunburns on the skin. It is very easy to endure the heat there, because the climate is not humid, and even at 38 degrees you feel good in your clothes. I was probably exotic in my clothes for tourists, vacationers, practically naked and even walking around the city in swimsuits! The attitude of the local population is respectful, everyone strove to get to know and talk about my religion better. As for food: despite the neighboring North Caucasus and its wide range of local Halal products, in Adler, I did not even find it in large supermarkets. The only thing that happened was a Sochi sausage called "Muslim" marked without pork, but we all know that not everything is "halal" that is called "Muslim". So I spent my fish and vegetable days of my vacation, which I do not regret at all.

Abkhazia. To get there, you need to cross the border between Russia and Abkhazia, and - this is a little, a lot from an hour to three, or even more. The very arrival on the territory of this country is striking in its beauty! This is the most wonderful corner of the earth with the purest sea and gentle sun. Enchanting nature, architectural monuments and beautiful places make your vacation in this country simply unforgettable. And these mountains, crashing into the clouds and with rushing rivers piercing them, are extraordinarily breathtaking.

Rest here is much quieter than in noisy Sochi, the sea is the cleanest and calmest on the entire Black Sea coast, the climate is milder. If you try, you can find a remote place for Muslim women to swim, which, by the way, can be found on the street. Prices are inexpensive, but you will have to fork out for souvenirs, since the main income of the local population is tourism, which lasts from May to October. Food is not so bad. One of my Muslim acquaintances, who was vacationing here in one of the boarding houses, said that the administrator made sure that a separate meal was prepared for her, it turns out that they have already had cases of rest from Muslim women. Most of all, I was struck by the confusion of two religions: Muslim (since the North Caucasus is beyond the mountains) and Christian, but, of course, today the latter prevails. The country is very ancient, there are few new buildings, a lot of post-war destruction, and there is not even an operating station and airport, but even this will not overshadow, truly, a pleasant pastime there.

It is good in Russia, but better abroad!

My friend decided to spend her vacation abroad - in Turkey, they say, a Muslim woman is better and more comfortable there. And, indeed! While I was "steaming" in search of a secluded place to swim for myself, Aliya basked and sunbathed on the beach of the hotel's swimming pool, protected from the gaze of men, which is surrounded by a fence, where there is no alcohol, men, discos, etc. Not all hotels there are like that, but it was this one called "Caprice" that fully corresponded to the Muslim way of life, there is even a rug for reading namaz and an indication of the direction of Qibla in the rooms.

“For me during my vacation there were no problems either with food, since everything in Turkey is halal, or with the language, since Turkish is similar to my native Tatar, and even though it is not easy, I could understand the speech and could express myself. I sunbathed as much as I wanted, though near our pool, and in the sea I swam in a burkini, as the beaches here are also packed with tourists, but there were a lot of girls in similar clothes ", - shares Aliya.

“And I was vacationing in Egypt, in Hurghada. I liked everything very much, halal food is not everywhere, but there are cafes and restaurants. There are a lot of Muslim tourists, our hotel was ordinary, but I also heard that there are hotels with private beaches where you can sunbathe ", - said Diana.

And here is what another friend of mine, who has been living in Dubai for several years, told me: “Exclusively for the female population on the beach, we have specially designated days - this is Monday, where all Muslim women can safely sunbathe and swim, without fear of the glances of men. And in general, it seems to me that the most wonderful vacation for Muslims who love comfort and novelty is in Dubai, everything is created here so that Muslim women feel good! ", - said Aida.

Every year, Muslim holidays are more and more in demand, and many travel companies seek to create certain conditions for those who wish. So, Muslim women will soon be able to comfortably relax in Italy. According to the Legend travel agency in the city of Riccione, the local authorities decided to make specialized beaches for Muslim women. A special bay on the coast of this resort will be fenced off and closed from men, and only women will be rescuers. This initiative stems from the fact that over the past few years Riccione has become a favorite holiday destination for tourists from the Arabian Peninsula.

Diniya Helmutdinova

Assalam aleikum wa rahmatullahi wa barakatukhu, dear sisters!
In today's article, I want to talk about how we visited the Maldives a couple of weeks ago. I usually write about the hotel, public places and attractions. But today I want to write about something completely different.

I was 6 years old when I first watched the program "In the world of animals", they showed the Maldives and the living creatures of the underwater world of this place. How surprised I was by this footage, SubhanAllah! Time passed, and the dream of visiting these islands did not leave me. Pictures from the Maldives have always fascinated me, and I wondered if there are such places on Earth created by Allah? And now my dream has come true, glory to Allah!

What kind of state is the Maldives?
Just imagine, a state in which more than 99.66% of the territory is occupied by ocean waters. The remaining 0.34% of the land is 1190 coral islands, and only 1/6 of them are inhabited by people.
Such a unique geographical location could not but affect the development of infrastructure and culture. After all, the Maldives are nothing more than a collection of isolated territories surrounded by water. Each (!) Inhabited island, even if it is the smallest, has its own mosque, power plant, sewage treatment system, desalination system, television tower and a huge refrigerator for storing food supplies.

By religion, 98% of the Maldives belong to the Sunnis, the largest and most traditional Islamic movement, that is, almost all residents are Muslims.

So, we arrived early in the morning by plane, flew through Dubai. This time the children stayed with their beloved grandparents, so my husband and I enjoyed the flight and the views from the porthole window and did not think about anything. We arrived in the capital of the Maldives - the city of Male. I can't say anything about him, since we immediately left for the island that we had chosen in advance for a week's stay - the island of Maafushi.

In general, there are two types of islands for tourists: a resort island and islands where the local population lives.

The island - a resort is a small island that can be slowly walked around in 15-20 minutes around the perimeter, and there is only one hotel on this island. And areas for service personnel. Everything. In general, for the majority of Russian non-Muslim tourists leaving for the Maldives, the fact that the country is deeply Muslim is a big surprise. But another fact becomes even more unexpected - there are no norms for the import of alcohol at all, that is, it is impossible to bring alcohol to the Maldives, as well as to buy it already on the island where the local population lives. Except for these resort islands. There, alcohol is served in the public domain - specifically for tourists. There are also animation programs and music discos. There are a lot of Russian tourists on these islands.

And the second type of islands are islands where the local Muslim population lives. On one such we lived - the island of Maafushi.

SubhanAllah, frankly speaking, for the first time I experienced incredible surprise from everything I saw. I'll start in order:

1. White sandy beaches, coconut palms and crystal clear water, juicy greens - all this left a colossal shock in my memory. Mashallah, looking at all this, my heart literally "burst" with delight. It is impossible to describe, these miracles of Allah must be seen with your own eyes at least once in your life! “Allahu akbar” was all I could say, looking at all this beauty.

Of course, having arrived from a country where it is -15C, we wanted to swim immediately, but the most interesting thing happened when we asked where the Muslim beach was.
We were told that the beach for Muslims is everywhere, and for non-Muslims there is a separate area with a high opaque fence. And the fact that swimming in an open swimsuit is possible only on this beach, and in other territory it is prohibited - only in burkini.

Mashallah, I am used to the fact that Muslims are fenced off separately, I was surprised that on this island I can swim wherever I want and I will not be afraid to meet women with naked aurat, subhanAllah!

The water in the ocean is very warm, and the shores seem to be created for the convenience of swimming. The sun is high, almost always at its zenith. The air is warm, the wind is pleasant. The weather is very comfortable, mashallah.

2. The island of Maafushi is home to approximately 2,500 indigenous Muslims. And 2 mosques were built for 2500 people. Azan is heard everywhere: in a hotel, on the shore, in a store, on the street. I didn't even open the application with prayer times, it just isn't needed there. Only a deaf person will not hear the adhan, which simultaneously walks from the minarets of two mosques.

I would like to tell you separately about the mosque. These are the most beautiful and cleanest buildings on the island. Nowhere else have I met such a reverent attitude towards the "house" of Allah. They go barefoot in mosques, even in toilets (!). Toilets are a separate topic. The cleanest, with all the comforts. This became a revelation for me, caused incredible respect for the inhabitants of the Maldives, and I felt incredibly ashamed of the state of our toilets in the mosques of Kazan.
Everywhere on the island it smells delicious, whether it is air fresheners, or whether it is flowers and greens that smell so sweet, I still did not understand.

There are a lot of people in the mosques, there are 3-4 rows of believers for the morning prayer. We went to namaz in mosques, they just beckon to themselves, with their beauty, purity and peace.

3. Lack of music on the island. Generally. We were in a “halal” hotel in Turkey a couple of years ago, loud music gave me a headache almost every day. Immediately I was surprised at my calmness and serenity. There is only one "music" on the island - adhan. In hotels there are no discos, animation programs, musical evenings, even on the beach, non-Muslims have no music.

4. Complete absence of alcohol and "halal" food. The import of alcohol and pork is prohibited on the island. All meat on the island is halal. I would also like to tell you about food. Basically, there is a lot of fish on the menu - tuna, reef fish and seafood. Wonderful, tasty fish and cheaper than beef or chicken. Everything is the other way around in Russia, this kind of fish is very expensive, so for almost a week I ate only fish for future use. Lots of vegetables and fruits. Delicious fruits: mango, papaya, coconut. Exotic fruits are inexpensive (when compared with prices in Russia). Everything else - clothes, souvenirs, cosmetics - are expensive, it is better to take your own. The food is fresh, it can be seen that it has been cooked to the fullest. There was no indigestion, alhamdullilah.

5. Excursions. The main entertainment in the Maldives is to travel to different islands. We went to the island of Biadu and Wadu. These are resort islands.

Byadu is a beautiful island with a lot of greenery, rich in different birds, crabs and other animals. With a very beautiful underwater view. There I had to do snokling for the first time.

Snokling - swimming with a mask and a snorkel over the water. Incredible views open up, mashallah! I swam next to such beautiful fish! Purple, pink, black, silver and even light green! What kind of creatures of Allah have I not seen there, SubhanAllah! This is such a beauty!

Vadu Island is a typical resort island, with a small area but a large freshwater pool.
You arrive on the excursion early in the morning by boat and they pick you up in the evening, after sunset.

6. Local residents. Actually, all week I was engaged in watching them. Calm, measured, smiling and hospitable. All women are wearing hijabs, and even girls aged 7-8 are already wearing headscarves. Every day I watched the schoolgirls who ran to classes in multi-colored headscarves and for the first time regretted that my daughter was not with me, she would see that there are schools where all the girls are in hijabs, and even on the street in 30C heat, they play and running around with their heads covered. Women are mainly engaged in raising children and at home, mostly men.

In general, for the first time I saw how people live and rely on Allah. We are running somewhere, trying to earn more money, buy a bigger apartment, a dacha, better than our neighbor's, a more expensive fur coat, a more modern car. And somewhere people live on a small island and thank Allah 5 times a day all together, for not being flooded, for having fish, tourists who bring at least a small income. Women protect their awrah, keep away from unfamiliar men, give birth a lot, bring up conscientiously. Men work diligently, behave very restrainedly with tourists (unlike Turks or Egyptians), do not cheat. Everyone prays 5 times a day, avoiding the forbidden, SubhanAllah, as much as they can. Living there, I was once again convinced that happiness is to live according to the laws of Islam. The laws of Islam are the most correct laws established by God. It is impossible not to love them. And the people of the Maldives once again proved it to me.

After a trip to the Maldives to the island of Maafushi, where local Muslims live, I realized that this is a Sharia holiday. There you rest not only with your body, but also with your soul! Once again you are convinced of the greatness of our Creator! After all, no one else could have created a more harmonious and beautiful world! This place cannot be compared either with Turkey, or with Egypt, not with Dubai! This is a completely different vacation.

I did not write anything about the hotel where we lived. Just because it really doesn't matter which hotel to stay in, so much it becomes secondary. But our hotel was very clean, the breakfasts were delicious and filling, and the staff were very friendly!

Many people write to me and ask how we got there, because ordinary operators do not sell tickets to local islands, but only to resort islands? I answer: we drove through. Now, a voucher for one person costs 59,900 rubles, this cost includes:

Flight
- accommodation in a 3 * hotel;
- breakfast buffet;
- meeting at the airport.
- transfer to the hotel after arrival.

A boat arrives for you directly to the airport and takes you to Maafushi.
Why do I advise you to go to Maafushi and not to the resort island:
- no alcohol and pork, all food is "halal".
- lack of entertainment activities with music.
- two mosques.
- Muslim beaches.
- few Russian-speaking tourists.
- women in a closed awrah.
- beautiful beach and nature.
- many restaurants with inexpensive and fresh food (lunch or dinner on the ocean shore will cost you around 500 rubles per person).
- friendly locals. An opportunity to see and study the life and everyday life of ordinary Maldivians. Indeed, in the Qur'an (49:13), it is said: “O people, Truly, We created you out of man and woman and made you peoples and tribes, so that you would recognize each other, and the most revered of you is the most God-fearing Truly, Allah-Knowing , Master ".
Mashallah!
