- Elena Vasilievna, according to current legislation, pensions for working pensioners are not indexed. What kind of adjustment are we talking about in this case?

This adjustment applies to those pensioners who worked during the past, in this case 2016, received an official salary, and payments were made from this salary to the Pension Fund of the Russian Federation. Obviously, if the amount of income from these people’s salaries to the Pension Fund has increased, then they have the right to recalculate their pension. The amount of the adjustment depends on the amount of funds that were transferred to the personal account of a particular person in the Pension Fund. The recalculation will take place without an application, that is, the pensioner himself does not need to contact either the Pension Fund authorities, or the social security departments, or the human resources department.

However, I note: since 2015, some restrictions have been applied when adjusting pensions - this applies to those working pensioners who receive high salaries. When recalculating the amount of your pension, not all contributions made to the Pension Fund will be taken into account, but only the amount that allowed you to gain no more than three pension points. And one point, let me remind you, is awarded for a salary of one minimum wage.

People have the right to indexation of pensions only after they quit their jobs. Last week, the State Duma Committee on Labor, Social Policy and Veterans Affairs recommended adopting in the second reading a bill that would shorten the time frame for such indexation. How quickly does this document require the process to happen?

When restrictions on the indexation of pensions for working pensioners were introduced in 2015, a rule was provided that while a person is working, his pension is not indexed, but if he quits, for example, 2-3 years after 2015, then when calculating the amount of his pension All indexes passed during this time will be summed up. That is, if in 2016 indexation was 4 percent, and this year - 5.8 percent, then a person who quits his job now should have his pension indexed by the amount of these indices - 9.8 percent. But it takes some time to recalculate. What are we actually facing? For example, a pensioner resigns on June 1, but the index is not given to him immediately after dismissal, but three to four months later, and the person loses the indexation amount during this time. And since August last year, both our Committee on Social Policy and I personally began to receive complaints from pensioners that they had not been working for several months, and their pensions were not being indexed. After this, my colleagues and I began to develop amendments to the law that would stipulate that the pension is indexed from the month following the month of dismissal. That is, if a person quit on June 1, then his pension should be indexed from July 1. Let me draw your attention - if he quit on June 30, then his pension should also be indexed from July 1. This will also happen without a declaration. Yes, the adjustment will not take place immediately, but at approximately the same time, in three to four months, since the administrative procedures that are currently in effect will remain in place. That is, the Pension Fund needs to receive the necessary data, process it, and calculate the amount of payments. But it is very important that pensioners’ money will not be lost, and after 3-4 months they will receive the entire amount due to them, taking into account indexation from the month following the month of dismissal. The Government supported our bill. The only question concerned the timing of the entry into force of this law. We proposed that the norm come into force on July 1, 2017. However, an amendment by the Ministry of Labor was adopted to postpone this deadline to January 1, 2018.

- Why was such a delay needed?

The first reason is purely technical. The first of July will come very soon, and, of course, it will not be possible to rebuild the system so quickly. The second question is financial. When the law on the budget of the Pension Fund for 2017 was adopted, these funds were not included in it. At first glance, it seems that the money required to implement this law is not so much: not so many pensioners are leaving, and the deadline is shifted by only 2-3 months. However, this amendment required almost four billion rubles. These are significant financial resources, and the Government, justifying its position to us, indicated that since these funds are not included in the budget, it would be advisable to adopt the law now, but stipulate that the norm will come into force in January 2018. I believe that there is nothing wrong with this. In the near future, I think the law will be adopted, and January is just around the corner.

Elena Vasilievna, several pensioners from Moscow have already contacted our editorial office and told us that at the entrance of their houses there are some notices with information that in the near future employees of the Pension Fund will be going around their apartments to fill out an application for registration of applications for pension certificate. Working pensioners, despite the fact that they receive wages, are also entitled to pension payments. Since 2016, annual indexation for these payments has been abolished, since citizens have an additional source of income.

The abolition of indexation is required to stabilize the economic situation in the country. However, this does not mean that there will be no increase in pension payments for working pensioners. Indexation is determined by annual inflation and serves as a way to maintain a decent standard of living. In fact, due to indexing, the payment amount increases.

The abolition of such an increase for working pensioners does not mean that the pension will not grow. From August 1, 2017, an annual recalculation is expected, which will allow recalculation of the number of IPB - individual pension points.

Important! Recalculation means a review of the pension file. The amount of the payment depends on the number of points, which are affected by length of service. If a citizen continues to work, then his length of service continues to grow and his points increase. It is for this purpose that a recalculation is made annually on August 1.

Since pensions for working pensioners will be recalculated from August 1, 2017, many are wondering how much the amount may increase. The legislation sets a limit on the maximum number of points that can be earned by citizens. In 2016, this number was 3 points; in 2017, this value did not change.

On average, the monthly salary must be 24 thousand rubles in order to accumulate this number of points in a year. If the salary is higher, then the calculation for pension will be taken according to the legal maximum - 3 points.

The amount of the increase consists of two indicators:

  • number of points earned;
  • the cost of one point.

So, if a person earned 2 points during the year of employment, and the cost of one point in 2017 is 78.58 rubles. , then the following will be added to the pension: 2*78.58=157.16 rubles. Important! In order to qualify for the pension recalculation program, the following conditions must be met:

  • official employment;
  • contribution to the Pension Fund.

In fact, the annual increase in payments due to an increase in seniority is not too large, but it compensates for the lack of indexation. Therefore, citizens should not count on a very large increase. This determines the increase in continued employment among citizens of retirement age. Attention! In order for your pension to be recalculated, you do not need to contact the Pension Fund in person. On August 1, 2017, an automatic recalculation will be made, and already in August citizens will receive the updated payment amount in a convenient way for them - through a banking organization or by mail.

After a person quits his job, the law guarantees him compensation for all missed indexations.

That is, after working for 3 years, receiving an increase of 1000 rubles. towards retirement, a citizen can count on the fact that the final amount will be increased again by the missed indexations. This allows you to receive additional funds after finishing your working career.

In addition, postponing retirement makes it possible to earn work experience, which affects the number of individual points on which the final pension amount depends.

If a citizen completed his labor activity before March 31, he must provide information to the Pension Fund independently. After this period, the data is transferred by the employer, and a personal visit to the Pension Fund is not required. The recalculation will be made automatically from August 1.

If, after changing the payment amount, the citizen returns to work, then indexing stops again, but the payment remains at the new level. At the same time, points for work experience will continue to accumulate. Upon termination of employment, the amount will be revised again automatically if this was done after March 31.

Indexing is frozen until 2018. There is no information that for working pensioners it will be abolished completely. There is also no information that the freeze will be lifted. In fact, such a “respite” for the Pension Fund allows you to significantly save budget funds, gradually correcting the economic situation.

The government is trying to maximally stimulate an increase in the period of employment among citizens of retirement age, since the latter lose little if they are refused to retire on time. That is why an annual additional payment was introduced, based on length of service.

Important! Pension recalculation means a change in the amount of the old-age insurance pension. However, citizens who also receive a funded payment can also count on its increase.

Self-employed citizens (individual entrepreneurs, lawyers, notaries, private doctors, and so on) usually make contributions to the Pension Fund for the funded part.

All accumulated funds are paid as a supplement to the pension. And when recalculating the payment amount, the funded part can also be increased, if there are grounds for this. All of them are regulated at the legislative level.

There are only two reasons for increasing savings payments:

Recalculation is made from the first day of the new month following the month of circulation.

CONDITIONS FOR INDEXING

The main and only purpose of indexation is to make up for pension losses in the consumer basket due to the constantly growing rise in prices. Such replenishment is carried out only over the insurance part of the pension (old age), over the disability pension and over the survivor's pension.

The question about indexing arises:

  • when prices rise by at least 6% over three months of a quarter, then indexation occurs 3 months after the quarter in which the threshold was exceeded, in other words, after a quarter;
  • when in the half-year inflation was at least 6% - then indexation will be carried out 6 months later, from the 1st day of the next half-year, but this is provided that the indexation factor did not play a role due to “quarterly inflation”;
  • when inflation was possibly less than 6% and when payments for “quarterly” or “semi-annual inflation” were not made - in this case, indexation is carried out on February 1.

The indexation coefficient is not defined by law; it is different each time, depending on the level of inflation and the capabilities of the state. The decision on indexation is made after a meeting of the Government of the Russian Federation. It is this that sets the final percentage of indexation, the starting date of its implementation and the period.

There is one more nuance. If the percentage of pension indexation for the year turns out to be less than the monthly increase in wages in the country, then after April 1 another indexation is carried out, taking this factor into account.

AN IMPORTANT INDEXING CONDITION THAT CANNOT NOT BE MENTIONED

And the last condition. The Pension Fund of Russia (PFR) is, to a certain extent, a commercial enterprise that invests funds collected from pensioners in various commercial initiatives that generate income. In general, pensions do not lie dead weight in the Fund, and this, in principle, is correct. Moreover, the Pension Fund is one of the most powerful financial institutions in the country.

So, the percentage of indexation cannot exceed the percentage of growth in Pension Fund income.

In other words, indexation is carried out at the expense of income received from the money of the pensioners themselves - every pensioner should understand this point very clearly.

Yes, the state takes care of its elderly fellow citizens, but only to the extent that it skillfully manages the money given to it by pensioners. This is how the return “pass” turns out.

Perhaps this answer may not seem very fair to some - as it is, my well-being depends on the ability of other people to conduct business for my money. But, in essence, this is so.

However, I think this is not the case when you want to take everything into your own hands.

Firstly, a pensioner no longer has the strength to move billions while managing a business at the very least.

And, secondly, those 20-50-year-old fellow citizens of pensioners who invest their money (they live on this, what can you do, I must admit), are quite qualified specialists, so that, at least at the state level, they trust.

CONDITIONS FOR INDEXING “LOCAL SIGNIFICANCE”

The next indexation of pensions will begin on the first day of August 2017. But only non-working pensioners, those who receive the insurance portion of their monthly payments from the state for old age or disability, can apply for it.

“Non-working”, but who worked in 2016 and, in any case, stopped working no later than May 1, 2017.

One pension point in 2017 is 78 rubles 58 kopecks (in 2016 it was 74.27).

Hence the conclusion - the maximum increase in any case in August 2017 will be no more than 235 rubles. 74 kopecks

Three points correspond to the average salary for the year of 24 thousand rubles. If it turned out more, then such a pensioner will still receive no more than “3 points.”

In addition, the rule applies if a pensioner worked throughout 2016 and missed this year’s indexation by 4%. Then he quit before May 1, 2017, then his pension will be indexed twice: for 2016 - by 1.04 and for 2017 - by 1.058.

In other words, if the pension by August 1 was 7844 rubles, and the average salary in 2016 was 25 thousand, then as a result the pension after recalculation and indexation will be:

7844.00 x 1.04 x 1.058 + 235.74 = 8630.31 + 235.74 = 8866.65 rubles

RECALCULATION OF PENSIONS

The reason for recalculating pensions is a change in external circumstances that affect the amount of the pension. And this matter concerns each pensioner personally, whether working or not.

Among these circumstances:

  1. Change of disability group.
  2. A citizen reaches the age of 80 years.
  3. Change in the number of persons receiving a labor pension upon loss of a breadwinner.
  4. Changing the category of persons receiving a labor pension in the event of the loss of a breadwinner.
  5. Achieving the required work experience in regions of the country with difficult working conditions - this is the Far North and regions equivalent in their difficult conditions to it.
  6. If you continue to work in retirement, your length of service will increase.

The law also provides for other reasons for recalculation, for example, a simple error or inaccuracy in calculating accruals made by employees of the Pension Fund.

All documents that confirm the need for recalculation must be submitted to the Pension Fund branch at the place of residence.

The most common reason when the pension needs to be increased for a working pensioner is the past year of work. If a year has passed, it means that the pensioner’s work experience has increased, since the employer paid pension benefits.

As a matter of fact, the Pension Fund of Russia makes (should make) such recalculation automatically from August 1, having information about transfers made by the employer. At the same time, the pensioner still has the opportunity to independently contact the Fund with an application for the need for recalculation.

Recalculation is carried out according to the following formula:

  • SP - new pension amount (after recalculation);
  • SS - previous pension size;
  • PV - the amount of pension contributions transferred to the Pension Fund;
  • M - number of months of work (payments).

The amount of recalculation when changing the category of disability is made according to the same formula.

The formula for recalculating the survivor's pension is a little more complicated:

SP = SS + PVR / (M x P) / NK,Where

  • SS - the amount of the pension on the last day of July;
  • PVR - the pension of the deceased breadwinner, calculated, but which was not taken into account on the date of his death;
  • M is the expected period of old-age pension payments;
  • P is the quotient of dividing the length of service of the breadwinner (in months) and the number “180” (as a constant reflecting the number of months over 15 years);
  • NK - the number of disabled family members receiving a pension, the breadwinner who has passed away.

The active life position of a pensioner and his desire to work “directly” with the Pension Fund when recalculating his pension can yield positive results.

The fact is that refusals to carry out recalculation are possible. In this case, the Fund is obliged to notify the pensioner no later than 5 working days about the reasons for the impossibility of recalculation, explain the procedure for objecting to the decision and, of course, return all the documents provided.

We only draw attention to two circumstances when pensions are not recalculated by law:

  1. If the pensioner is working and the survivor's pension is a pension, the fact is that these calculations are based on the pension contributions of the deceased person, and not the recipient himself.
  2. If the pension comes from the Ministry of Defense, the Ministry of Internal Affairs and other similar organizations.

In any case, errors in recalculation made by Pension Fund employees have neither a statute of limitations nor a deadline for execution. They must be corrected immediately when identified.

If a pensioner does not agree with the refusal to recalculate, he has the right to appeal to a higher branch of the Pension Fund or to the judicial authorities.

Recalculation of pensions for working citizens from August 1

When recalculating, not all contributions made by the employer are taken into account, but only the amount that allows you to gain no more than three pension points. One PB is equal to one minimum wage.

Currently, a working pensioner does not have the right to indexation. However, after the complete cessation of work, he is required to make an adjustment taking into account all missed recalculations. This procedure takes a certain amount of time, during which he receives a pension in the same amount. In this regard, the Committee is working to introduce appropriate amendments to the law - if a person quits, then the recalculation and payment of pensions should be made as early as next month, and not later.
