Whoever owns a house in private ownership, and in addition to it also an impressive land plot, knows what paperwork is about drawing up a technical plan for housing, surveying and other activities in the same spirit. In solving such problems, one cannot do without the help and direct participation of a cadastral engineer. This profession is relatively new and very important. On July 24, the people who own it - our compatriots - celebrate their professional holiday: the Day of the Cadastral Engineer in Russia.

Holiday information

A quite definite number for honoring the performers of cadastral works was chosen in accordance with an event that took place in the mid-2000s. On July 24, 2007, Federal Law No. 221-FZ “On the State Real Estate Cadastre” came into force. The initiative to establish the Day of Cadastral Engineer in Russia came from representatives of the Self-Regulatory Organization Non-Commercial Partnership "Cadastral Engineers" (abbreviated SRO NP).

4 years after the adoption of the above law, namely from January 1, 2011, its provision came into force that cadastral activities in relation to land plots are exclusively entitled to be carried out by cadastral engineers, moreover, with a valid certificate (valid) confirming the qualifications of their as specialists. Currently, more than 30 thousand cadastral engineers are certified. Information about them is contained in the state register of the relevant specialists. What does “certified” mean? This term should be understood as follows: the performers have passed the qualification exam, have a qualification certificate in their hands and can legally carry out cadastral work on the territory of Russia.

In the ranks of the above-mentioned SRO NP "Cadastral Engineers" there are already more than 4,000 cadastral engineers from most Russian regions. But this is not the only organization of this kind: in 2012, the National Association of Self-Regulatory Organizations in the Field of Cadastral Activities emerged and began to function. This association has taken under its wing 11 SROs operating on the territory of the Russian Federation.

How do cadastral engineers celebrate their professional holiday? Like people of any other socially significant profession: experiencing solidarity with colleagues at conferences, seminars, meetings, congresses, accepting congratulations and gratitude from the authorities and employees, in discussions of acute problems of the field of activity and solutions to pressing issues.

The name of the specialty "cadastral engineer" comes from the French word "cadastre", meaning "inventory of property". And, indeed, the activities of the executors of cadastral works are directly related, first of all, to land surveying. And surveying, in turn, is nothing more than the determination of the coordinates of the boundaries of land ownership, the implementation of boundary plans and the preparation of relevant documents in order to register the property with the state. It was already mentioned above that the profession of a cadastral engineer is relatively new.

So it is, because officially this specialty has existed only for the last four years. Until 2011, the duties of a cadastral engineer were performed by land surveyors. The new profession imposes a great responsibility on a person: he is individually responsible for the mistakes he made in calculations, measurements and documentation. As a result, the result of the work done is of high quality - much higher than that of land surveyors.

The services provided by cadastral engineers to the population of Russia are very popular among, as mentioned at the beginning of this article, the owners of private real estate and land plots. Of course, in principle, they are forced to invite a cadastral engineer to perform a certain list of specific works, because this is prescribed by law. However, in some cases, the activities of people in the profession we are considering turns out to be very useful, for example, when:

  • buying and selling;

  • registration of inheritance;

  • resolving conflicts with neighbors, especially over land borders;

  • confirmation of the right to build a house at a specific place;

  • consolidation / division of plots of property, etc.

How is the work of a cadastral engineer carried out? It can be roughly divided into several stages. The first stage is characterized by the initiation by him of checking the documents of the owners of the housing / land plot - whether all of them are on hand. Then he makes a thorough technical survey of the territory owned by the owners, using specific technical means. At the end of this process, the third stage begins, when a certified cadastral contractor coordinates all the measurements taken by him with the neighbors of the person who turned to him for the services. When this part of the activity is completed, the cadastral engineer installs all the necessary landmarks, draws the required plans and along the way prepares a package of documents for submission to the state accounting authorities. The cadastral contractor is also responsible for advising clients on land management issues. Among other things, he can resolve conflicts between clients.

A cadastral engineer is either acting as a sole proprietor or is an employee of a typical firm providing legal or real estate services. The activity of the cadastral contractor is not tied to any one place. A person who has mastered this profession and taken the appropriate position should be ready for constant travel, business trips. It's great if the cadastral engineer has a driver's license and his own car.

Qualities and knowledge of the employee

A representative of any profession must have a number of traits in order to fulfill the assigned labor duties for 5+. This also applies to the cadastral engineer.

First, he simply has to be the most responsible subject. Errors made by a cadastral engineer in measurements and documents can cost him property and a certificate. It follows that equally important qualities of the cadastral contractor are the utmost accuracy and attentiveness.

The next point is the presence of a technical mindset in the carrier of the profession of a cadastral engineer. Here you can also mention analytical skills.

Finally, since the cadastral engineer constantly deals with people on duty, it is simply vital for him to be sociable, to be able to show diplomacy. This is impossible without high stress resistance.

In conclusion, it should be noted that the cadastral engineer must know land, housing, civil, urban planning, forestry and water legislation. This requires a good memory. Possession of skills in working with geodetic instruments is also necessary.

From January 1, 2017, new rules for registering real estate rights have been introduced. They simplify the registration process

On January 1, 2017, the Federal Law of July 13, 2015 No. 218-FZ "On state registration of real estate" (hereinafter - Law No. 218-FZ) came into force. It repeals Federal Law No. 122-FZ of July 21, 1997 "On State Registration of Rights to Real Estate and Transactions with It" (hereinafter - Law No. 122-FZ). Let's consider 9 changes that will simplify the registration of rights to real estate.

New basis for registration of rights to real estate

All the grounds for registration of rights, which were indicated in article 17 of Law No. 122-FZ, are also contained in article 14 of Law No. 218-FZ.

Since January 1, 2017, a new basis has appeared - the onset of circumstances that are specified in the federal law (clause 9, part 2, article 14 of Law No. 218-FZ). We are talking about the rights to real estate that arise by virtue of the law:

Due to circumstances specified in the law,

· Not from the date of state registration of rights.

Such rights are legally valid even without state registration in the USRN.

Rosreestr carries out their registration in the USRN:

· According to the statements of the copyright holders;

· The decision of the registrar upon receipt of information from the authorities and notaries that confirms the fact of the emergence of such rights, except for cases established by federal laws (part 2 of article 69 of Law No. 218-FZ).

Who can apply for registration of rights to real estate

In Law No. 218-FZ there are no fundamentally new rules and regulations that would change the composition of persons with the right to apply for registration of rights (cadastral registration). The difference is as follows.

All persons, upon whose application the registration is carried out, are now listed in one article of Law No. 218-FZ - Article 15 "Persons upon whose application the state cadastral registration and state registration of rights are carried out":

· In part 1 - persons, upon whose application Rosreestr simultaneously conducts both state cadastral registration and registration of rights;

· In part 2 - persons, according to whose application Rosreestr conducts only state cadastral registration without simultaneous registration of rights;

· In part 3 - persons, upon whose request Rosreestr is registering rights without simultaneous state cadastral registration.

Previously, the persons on whose application Rosreestr registered were listed in various articles of Law No. 122-FZ.

Rosreestr will request constituent documents from the tax

Law No. 218-FZ will simplify the procedure for collecting additional documents for registration of rights that the applicant must submit to Rosreestr in addition to the basic documents regarding the property and rights to it.

Previously, Rosreestr itself only requested an extract from the Unified State Register of Legal Entities in respect of the applicant (paragraph 9, clause 2, article 16 of Law No. 122-FZ). In addition, the constituent documents (or their notarized copies) could not have been submitted to Rosreestr only in two cases:

If earlier the constituent documents have already been submitted and the registration of the legal entity's right to the corresponding real estate object has been carried out,

· If from the moment of registration of the legal entity's rights the tax authority has not registered changes to its constituent documents.

In all other cases, the applicant had to submit these documents to Rosreestr on his own.

Law No. 218-FZ obliged Rosreestr to independently request from the tax authority the constituent documents of the applicant (part 9 of article 18 of Law No. 218-FZ). In this case, it does not matter whether they were previously submitted by the applicant for registration of rights and whether they made changes to them.

Requirements for documents for registration of rights

Most of the requirements for documents submitted for registration in Law No. 218-FZ remained unchanged. However, from January 1, 2017, some requirements will change.

Only one original must be submitted for registration (part 3 of article 21 of Law No. 218-FZ). Simplification applies to paper documents that:

Express the content of the transaction and

· Serve as the basis for registering the presence, occurrence, termination, transfer, limitation of rights and encumbrances of real estate.

The applicant submits them for registration:

· In at least two original copies, one of which is returned to the copyright holder, the second is placed in the registry file, if the transaction is made in simple writing;

· At least in two copies, one of which (original) is returned to the rightholder - if the transaction was made in notarial form or the right on the basis of the transaction arose before the entry into force of Law No. 122-FZ.

Previously, it was necessary to submit for registration (part 5 of article 18 of Law No. 122-FZ):

· Two original copies, one of which, after registration of rights, was returned to the copyright holder, the second was placed in the case of title documents, if the transaction was made in a simple written form;

· Two copies, one of which (original) after registration of rights was returned to the copyright holder - if the right on the basis of the transaction arose before the entry into force of Law No. 122-FZ.

It is necessary to submit copies (and not originals) of acts of state bodies and the court (part 5 of article 21 of Law No. 218-FZ). The applicant submits for registration in one copy a copy of:

· Acts of public authorities,

· Acts of local self-government bodies,

· Judicial acts that establish rights to real estate.

Rosreestr scans them and returns them to the applicant after registration.

Documents on registration of the right to real estate can be submitted from anywhere in the world

It is possible regardless of the location of the property:

Send documents by mail or

· Contact Rosreestr or MFC.

Part 2 of Article 18 of Law No. 218-FZ explicitly states: "... documents ... on paper through personal appeal are submitted regardless of the location of the property ...".

This rule applies to the application (and the documents that are attached to it):

On state cadastral registration and (or)

· Registration of rights.

The applicant can:

· Submit documents in person to the department of Rosreestr or to the MFC according to the list, which is published on the official website;

· Send paper documents by mail.

Documents can be submitted through the field department of Rosreestr

An important innovation is the registration of rights during the on-site reception of documents by Rosreestr employees. In this case, the applicant submits the application and the documents attached to it in the form of documents on paper, personally contacting an authorized person of Rosreestr (clause 1 of part 1 of article 18 of Law No. 218-FZ).

Rosreestr published on the official website a list of units that are engaged in field reception (paragraph 3, sub. 1, paragraph 2 of the Procedure for submitting an application for state cadastral registration of real estate and (or) state registration of rights to real estate and documents attached to it, approved by order of the Ministry of Economic Development Russia dated November 26, 2015 No. 883).

State agencies themselves will transfer documents to Rosreestr

The registration procedure will be simplified if the right arises on the basis of:

An act of a state body,

· Act of local government,

· Agreements or contracts with a government or local government body.

According to the previous procedure, if the right arose on the basis of:

· An act of a state body or an act of a local self-government body, then an application for registration was submitted by the person in respect of whom the specified acts were adopted;

· Agreements or contracts with a public authority or local self-government body, the application was submitted by both these bodies and the person who entered into the contract or agreement (part 1 of article 16 of Law No. 122-FZ).

Law No. 218-FZ establishes a fundamentally new registration procedure (part 2 of article 19). The state body (or local self-government body) is obliged to send documents for registration to Rosreestr no later than five working days:

1.From the date when the act was adopted, according to which arises:

· Right,

Limitation of the right,

· Encumbrance of the property.

2.From the date when the transaction in relation to real estate (including a transaction that was made on the basis of an act of a public authority or local government body).

Rosreestr will be obliged to notify about the application for registration of the right

Rosreestr is obliged to notify the copyright holder that an application for registration of rights has been received with respect to his real estate. He must do this on the day of receipt of the application, provided that information about the real estate is in the USRN.

For this, the Ministry of Economic Development of Russia approved the Procedure for notification by the registration authority of the rights holder of the receipt of an application for state registration of rights to a real estate object, information about which is contained in the Unified State Register of Real Estate (Order No. 127 dated March 15, 2016).

Until 2017, Rosreestr was obliged to notify the owner of the real estate within five working days only during state registration:

Restrictions (encumbrances) of rights established in accordance with the legislation in the public interest by public authorities and local self-government bodies on the initiative of these bodies, or

· Restrictions (encumbrances) of property rights and other property rights by the rights of third parties (paragraph 2 of part 2 of article 13 of Law No. 122-FZ).

The term of registration of the right to real estate will be reduced

Previously, as a general rule, registration of rights was carried out within 10 working days from the date of receipt of the application and documents (part 3 of article 13 of Law No. 122-FZ).

Exception - state registration:

· Mortgages of land plots, buildings, structures, non-residential premises (carried out no later than 15 working days);

· Mortgages of residential premises (carried out no later than five working days);

· On the basis of notarized documents (carried out no later than three working days);

· On the basis of notarized documents submitted in the form of electronic documents, electronic images of documents and an application for state registration of rights submitted by a notary in electronic form (carried out no later than one business day).

Since 2017, a fundamentally new approach to the timing of registration actions (Art. 16 of Law No. 218-FZ).

The registration period now depends on where the applicant applies:

Directly to Rosreestr or

· In the MFC.
