4. The authorized body of a member state monthly, on the 5th working day of the month following the reporting month, sends to the Eurasian Economic Commission the information provided for in paragraph 3 of this Regulation for the last reporting day of the reporting month and on an accrual basis from the beginning of the calendar year in the form provided for these Regulations.

6. Mantulo E.V. applied to the court with a statement of claim to the State Budgetary Healthcare Institution "Chaunskaya District Hospital" (hereinafter - GBUZ "Chaunskaya District Hospital", the defendant) to recover the final payment in the amount. the period for the payment of wages for DD.MM.YYYY in the amount., for DD.MM.YYYY in the amount., compensation for unused vacation, taking into account the inclusion of payments for the provision of paid services in the calculation of the average salary, stimulating allowances for complexity for DD.MM .YYYY in the amount., Compensation for non-pecuniary damage in the amount.

In substantiating the claims Mantulo E.The. indicated that by order from DD.MM.YYYY No. he was employed in the State Institution "Chukotka Regional Hospital" branch - Chaunskaya District Hospital for the position. DD.MM.YYYY in connection with the reorganization of the institution in the form of separation a new legal entity was formed - the State budgetary healthcare institution "Chaunskaya district hospital", which is the legal successor of the GBUZ "Chukotka district hospital". By order from DD.MM.YYYY No. the employment contract was terminated with him under paragraph 3 of Part 1 of Article on the initiative of the employee (ld.47, volume 1). On the day of dismissal, he was issued a work book, but the final settlement with him was not made in full: compensation for unused vacation and wages for 9 days of work in DD.MM.YYYY were not paid in total. As a result of the unlawful actions of the defendant, he suffered moral suffering, he experienced a sense of humiliation, material difficulties in connection with the change of work, the departure of the child to enter the university.

By the determination of the Chaunskiy District Court DD.MM.YYYY the proceedings in the present case regarding the requirements for the recovery of the final payment in the amount .; monetary compensation for unpaid amounts due upon dismissal on time; for violation of the term of payment of wages for DD.MM.YYYY and DD.MM.YYYY; compensation for unused vacation, taking into account the inclusion in the calculation of the average salary payments for the provision of paid services, terminated in connection with the refusal of the plaintiff Mantulo E.The. from these requirements.

In the rest of the requirements, the court ruled a decision, the operative part of which is given above.

In the appeal, the plaintiff Mantulo E.V., pointing out the incorrect application by the court of substantive law, asks the court to cancel the decision and make a new decision to satisfy the stated claims.

In written objections to the appeal the defendant GBUZ "Chaunskaya district hospital" asks to leave the decision of the first instance court unchanged, pointing out its legality and validity, the appeal Mantulo E.The. - without satisfaction.

The plaintiff Mantulo E.V., the defendant GBUZ "Chaunskaya district hospital" did not appear at the hearing of the court of appeal, they were notified of the place and time of the trial in advance and properly, they did not report good reasons for failure to appear, they did not file any requests to postpone the consideration of the case. ...

After examining the materials of the case, evaluating the evidence in it, checking the court's decision in accordance with Part 1 of Article on the basis of the arguments of the plaintiff's appeal, having discussed these arguments and objections to it, the panel of judges comes to the following.

The court as a whole fully and correctly determined the legally significant circumstances that are relevant to the case, the evidence presented by the parties was given a proper legal assessment, the legality and validity of which does not raise doubts among the collegium.

Refusing the plaintiff to satisfy the claim for the recovery of the incentive allowance for DD.MM.YYYY in the amount the employer's responsibility. The establishment of allowances is an additional labor guarantee aimed at increasing the level of wages and encouraging the employee to work in a given organization of high quality. The incentive bonus is paid by the defendant on the basis of the orders of the chief physician, based on the results of the month's work as a percentage of the established salary.

The panel of judges finds these conclusions of the first instance court sufficiently motivated, based on the correct application of the substantive law governing controversial legal relations, corresponding to the factual circumstances of the case and the law, and therefore does not see the need to reiterate their reasoning in this ruling.

The argument of the appeal Mantulo E.The. that the court, when resolving the dispute, did not take into account the provisions of the Uniform Recommendations for the establishment at the federal, regional and local levels of salary systems for employees of state and municipal institutions for 2014, approved by the decision of the Russian Tripartite Commission for the Regulation of Social and Labor Relations dated December 25, 2013 , Protocol No. 11 (hereinafter referred to as the Recommendations), defining the principles of the formation of federal, regional and municipal systems of remuneration, in particular, ensuring the dependence of the wages of each employee on his qualifications, the complexity of the work performed, the quantity and quality of labor expended without limiting its maximum size; ensuring the employer of equal pay for work of equal value when setting the size of tariff rates, salaries (official salaries), wage rates, compensation and incentive payments, as well as the prevention of any discrimination - differences, exceptions and preferences not related to business qualities of workers.

Part 1 of the article, containing the basic concepts and definitions, discloses the content of wages (employee remuneration), consisting of remuneration for labor depending on the qualifications of the employee, the complexity, quantity, quality and conditions of the work performed, as well as compensation and incentive payments.

At the same time, in accordance with parts 1 and 2 of the article, the salary of each employee depends on his qualifications, the complexity of the work performed, the quantity and quality of labor expended and is not limited to the maximum amount; it is prohibited to discriminate of any kind in the establishment and amendment of conditions of remuneration.

In accordance with the article, the salary of the employee is established by the employment contract in accordance with the labor remuneration systems in force for the given employer.

Remuneration systems, including the size of wage rates, salaries (official salaries), additional payments and allowances of a compensatory nature, including for work in conditions deviating from normal regulatory acts in accordance with labor legislation and other regulatory legal acts containing labor law norms.

According to subparagraph "b" of paragraph 6 of section IV "Systems of remuneration of employees of state and municipal institutions" of the above Recommendations of the remuneration system (including tariff systems of remuneration) in state institutions of the constituent entities of the Russian Federation are established by collective agreements, agreements, local regulations in accordance with with federal laws and other regulatory legal acts of the Russian Federation, laws and other regulatory legal acts of the constituent entities of the Russian Federation.

It follows from the above legal norms that remuneration systems are established by the employer in accordance with labor legislation and other regulatory legal acts of the Russian Federation and the constituent entities of the Russian Federation containing labor law norms, and the Recommendations pointed out by the plaintiff in the appeal actually reproduce the provisions of the Labor Code RF.

The sectoral system of remuneration for employees of state healthcare institutions of the Chukotka Autonomous Okrug, financed from the district budget and the budget of the Chukotka territorial compulsory medical insurance fund, is determined by the Regulation on the sectoral system of remuneration for employees of state healthcare institutions of the Chukotka Autonomous Okrug, approved by the resolution of the Government of the Chukotka Autonomous Okrug dated January 16, 2014 year number 15 (hereinafter - the Regulation).

According to clauses 1.4. and 1.5. The regulations for health care workers provide for uniform conditions of remuneration based on the salary (official salary), compensation and incentive payments, with the exception of other incentive payments provided for by local regulations of health care institutions at the expense of an additional incentive fund for the payroll of health care institution employees. The conditions for remuneration of an employee of a health care institution, including salary (official salary) and payments of a compensatory and incentive nature, are established by the head of the health care institution individually.

In accordance with this Regulation, the defendant, by order of February 3, 2014 No. 20, approved the Regulation on remuneration of employees of the Chaunskaya regional hospital, which established the sectoral system of remuneration for the Chaunskaya regional hospital, including in terms of determining the procedure and conditions for establishing incentive payments.

As follows from the materials of the case, resolving the dispute, the court of first instance was guided by the provisions of the labor legislation of the Russian Federation, regulating controversial legal relations, and also took into account the Regulations on the remuneration of workers GBUZ "Chaunskaya district hospital", the conditions of the prisoner between the plaintiff Mantulo E.The. and the defendant of the employment contract.

Considering that the Recommendations were developed by the Russian tripartite commission for the regulation of social and labor relations in accordance with the article, the fact that the court of first instance did not cite them in its decision does not indicate the illegality of the decree.

The argument of the appeal Mantulo E.The. on the illegality of the judgment due to the fact that the court, when making it, did not take into account and did not reflect in the decision the requirements of paragraph 4.15. Regulations on the sectoral system of remuneration for employees of public health institutions of the Chukotka Autonomous Okrug, approved by the Government of the Chukotka Autonomous Okrug dated January 16, 2014 No. 15, is based on the plaintiff's misinterpretation of substantive law.

According to subparagraph "g" of paragraph 4.1. Regulations on the remuneration of employees of the GBUZ "Chaunskaya district hospital" employees can be established incentive payments by order of the head of the institution.

In accordance with clause 4.6. of this Regulation on labor remuneration, performance-based allowances are established within the wage fund as a percentage of the salary or in a fixed amount. The allowances are established by order of the health care institution for a specified period and are not limited to the maximum amount. The amount of allowances can be revised downward or canceled completely.

Clause 4.15. Regulations on the sectoral system of remuneration for employees of state healthcare institutions of the Chukotka Autonomous Okrug, a list of incentive bonuses is fixed, and it is also provided that incentive bonuses, including for the complexity and (or) intensity of the work performed, can be revised downward or completely canceled in in the case of: a decrease or absence of an additional volume of work; reducing the intensity of work; non-fulfillment or improper fulfillment by the employee of his functional duties; violations of labor discipline; non-performance, untimely or poor-quality performance of the most significant, urgent work or tasks of a superior official within the employee's professional competence; inaction, lack of initiative, efficiency and effectiveness in work; the existence of a well-founded complaint about the employee from the patient and employees; industrial injuries caused by the employee; failure to comply with fire safety rules.

Thus, contrary to the argument of the appeal, the named clause of the branch regulation resolved the issue not of establishing, as the plaintiff mistakenly believes, but of reducing or canceling the incentive premium.

As follows from the materials of the case, the premium for complexity was paid to the plaintiff in DD.MM.YYYY monthly for the period from DD.MM.YYYY inclusive. In DD.MM.YYYY this allowance was paid to Mantulo E.The. in the period from DD.MM.YYYY inclusive.

From the orders available in the case from DD.MM.YYYY №, from DD.MM.YYYY № and the annexes to them, it appears that the premium for difficult and strenuous work for the period from DD.MM.YYYY to the plaintiff was not established.

Since, according to the results of work for DD.MM.YYYY, the incentive allowance was not established for the plaintiff, which, as indicated above in this determination, is the exclusive right of the employer, the court of first instance has grounds for applying paragraph 4.15 to the dispute that has arisen. there was no specified Regulation.

The argument of the appeal that the court's decision should be regarded as incompatible with the principle of equality of all before the law and the court, enshrined in the article of the Russian Federation, the board finds untenable.

Motivating this argument, Mantulo E.V. confined himself to only pointing out that equality before the law and the court excludes formal differences and the need to take them into account by the court. At the same time, the plaintiff did not specify which, in his opinion, the conclusions of the first instance court did not meet the above principle.

Meanwhile, coming to the conclusion that the establishment of an allowance for difficult and strenuous work is a right, and not an obligation of the employer, the court of first instance was reasonably guided by the norms of labor legislation of the Russian Federation, a local normative act of the defendant, according to which the procedure and conditions for the payment of incentive allowances are determined employer.

According to the legal position of the Constitutional Court of the Russian Federation, expressed in a number of its decisions (Resolution of December 20, 2010 No. 21-P, Resolution of March 1, 2012 No. 5-P), the observance of the constitutional principle of equality, which guarantees protection against all forms of discrimination in the exercise of rights and freedoms, means, among other things, the prohibition to impose restrictions on the rights of persons belonging to one category, but does not prevent the legislator from using a differentiated approach to establishing rights and obligations for different categories of subjects of law.

Since the legislator has endowed the employer with the right to independently establish the remuneration system in the organization, including to determine in local regulatory acts the conditions and procedure for the payment of incentive allowances, the non-payment of this allowance to the plaintiff DD.MM.YYYY in itself does not testify to the discrimination of the rights of Mantulo E made by the defendant. .V. in the world of work, and on the contradiction of the conclusions of the court of first instance, set out in the decision, enshrined in the article of the Russian Federation, the principle of equality of all before the law and the court.

Other reasons the appeal Mantulo E.The. does not contain.

Summarizing the foregoing, the panel of judges sees no grounds for canceling the contested decision of the first instance court based on the arguments of the plaintiff's appeal Mantulo E.The.

Violations of the norms of procedural law, entailing the unconditional cancellation of the court decision held in this case, were not established by the panel.
