In accordance with Part 4 of Article 31 of the Federal Law "On the Basics of Social Services for Citizens in the Russian Federation" the Government of the Russian Federation

decides:

1. To approve the attached Rules for determining the average per capita income for the provision of social services free of charge.

2. The Ministry of Labor and Social Protection of the Russian Federation, together with the Ministry of Finance of the Russian Federation, shall provide clarifications on the application of the Rules approved by this resolution.

1. These Rules establish the procedure for determining the average per capita income for the provision of social services free of charge in order to implement the Federal Law "On the Basics of Social Services for Citizens in the Russian Federation" (hereinafter referred to as the average per capita income).

2. The calculation of the average per capita income in relation to the recipient of social services, with the exception of the persons specified in parts 1 and 3 of Article 31 of the Federal Law "On the Basics of Social Services for Citizens in the Russian Federation" the procedure for the provision of social services, approved by the authorized government body, on the composition of the family, the presence (absence) of income of family members or a single citizen and property belonging to him (him) by right of ownership.

3. For the purposes of these Rules:

a) the family includes spouses, parents and minor children living together with the recipient of social services;

b) the date of appeal means the date of filing an application for the provision of social services or the date of submission of information on changes in the composition of the family, income of family members or a single citizen and property belonging to him (him) on the basis of ownership.

4. When calculating the average per capita income, the family does not include:

a) persons serving a sentence of imprisonment, persons in respect of whom a preventive measure in the form of detention has been applied, as well as persons undergoing compulsory treatment by a court decision;

b) persons who are fully supported by the state.

5. When calculating the average per capita income, the following income received in cash is taken into account:

a) dividends and interest received from a Russian organization, as well as interest received from Russian individual entrepreneurs and (or) a foreign organization in connection with the activities of its separate subdivision in the Russian Federation;

b) insurance payments in the event of an insured event, including periodic insurance payments (annuities, annuities) and (or) payments related to the participation of the policyholder in the investment income of the insurer, as well as redemption amounts received from a Russian organization and (or) from a foreign organizations in connection with the activities of its separate subdivision in the Russian Federation;

c) income received from the use of copyright or related rights in the Russian Federation;

d) income received from the lease or other use of property located in the Russian Federation;

e) income from sales:

real estate located in the Russian Federation;

in the Russian Federation, shares or other securities, as well as stakes in the authorized capital of organizations;

in the Russian Federation, shares, other securities, shares of participation in the authorized capital of organizations received from participation in an investment partnership;

rights of claim against a Russian organization or a foreign organization in connection with the activities of its separate subdivision on the territory of the Russian Federation;

other property located in the Russian Federation and owned by a citizen;

f) remuneration for the performance of labor or other duties, work performed, service rendered, action in the Russian Federation. At the same time, remuneration of directors and other similar payments received by members of the management body of an organization (board of directors or other similar body) that is a tax resident of the Russian Federation, the location (management) of which is the Russian Federation, are considered as income received from sources in the Russian Federation, regardless of from the place where the administrative duties assigned to these persons were actually performed or from where the payments of the specified remuneration were made;

g) pensions, allowances, scholarships and other similar payments received by a citizen in accordance with the legislation of the Russian Federation or received from a foreign organization in connection with the activities of its separate subdivision in the Russian Federation;

h) income received from the use of any means of transport, including sea, river, aircraft and motor vehicles, in connection with transportation to the Russian Federation and (or) from the Russian Federation or within its limits, as well as fines and other sanctions for idle time (delay) of such vehicles at the points of loading (unloading) in the Russian Federation;

i) income received from the use of pipelines, power lines, fiber-optic and (or) wireless communication lines, other means of communication, including computer networks, on the territory of the Russian Federation;

j) payments to the legal successors of deceased insured persons in cases stipulated by the legislation of the Russian Federation on compulsory pension insurance;

k) other income received by a citizen as a result of his activities in the Russian Federation;

l) compensation paid by a state body or public association for the period of performance of state or public duties;

m) monetary allowances for military personnel, employees of the internal affairs bodies of the Russian Federation, institutions and bodies of the penal system, customs authorities of the Russian Federation and other law enforcement agencies, as well as additional payments of a permanent nature and food security (monetary compensation in exchange for food rations) established by the legislation of the Russian Federation;

n) monetary remuneration under an agreement on the exercise of guardianship or trusteeship, as well as monetary payments under contracts of annuity, life support with dependents.

6. Income received in foreign currency shall be recalculated into rubles at the rate of the Central Bank of the Russian Federation established on the date of actual receipt of these incomes.

7. Income is recorded before taxes and fees in accordance with the legislation of the Russian Federation.

8. The amount of wages, including payments of a compensatory and incentive nature, provided for by the remuneration system and paid according to the results of work for a month, is taken into account in the income of a family or a single citizen in the month of its actual receipt, which falls on the billing period. In case of other established terms for the calculation and payment of wages, including payments of a compensatory and stimulating nature, the amount of wages received, including payments of a compensatory and incentive nature, is divided by the number of months for which it was accrued, and is taken into account in the income of a family or a lonely citizen for those months that fall on the billing period.

9. The amounts of payment for seasonal, temporary and other types of work performed under fixed-term employment contracts, income received from the execution of contracts of a civil nature, as well as income received from entrepreneurial and other activities, are divided by the number of months for which they are accrued (received), and are taken into account in the income of a family or a single living citizen for those months that fall on the billing period.

10. The amounts of income received from the lease (lease) of real estate and other property are divided by the number of months for which they are received, and are taken into account in income for those months that fall on the billing period.

11. The calculation of the average per capita income is based on the amount of income of family members or a citizen living alone for the last 12 calendar months preceding the month of filing an application for the provision of social services.

12. Average per capita income is calculated by dividing one-twelfth of the income of all family members for the accounting period by the number of family members.

13. The income of a citizen living alone is defined as one-twelfth of the amount of his income for the billing period.
