All other clubs without a license should not teach anything. But here's what they can do:

entertain;
conduct classes for socialization and general development.

Let's analyze what is possible and what is impossible for children's centers in each of these cases.

A license is not needed if the individual entrepreneur works personally and does not hire teachers

In 2013, the law divided entrepreneurs:

they work on their own, do not hire teachers in the state - a license is not needed;
open children's clubs and hire teachers in the state - you need a license. And managers will have to receive a certificate of "Management in Education", three-month distance professional retraining courses are enough.

To open a children's club without a license, an entrepreneur must work on his own, without hired teachers. To do this, he will have to receive a specialized education. For example, for drawing courses, a higher education diploma "Teacher of Fine Arts" or a secondary education in the specialty "Painting" is suitable. If he is an economist by education, it is enough to take retraining courses, for example, under the program “Teacher of Fine Arts in Organizations additional education».

You can hire an administrator, cook, instructor, cleaner or nanny on the staff, but you cannot hire a person with the position of educator, teacher, teacher, teacher, methodologist in the work book.

Olga is a musician and plays the flute with kids from three years old. She teaches herself, so she doesn't need a license.

The club without a license look after the children

If children walk and play, they are fed and put to bed according to the regimen, a license is not needed. The club concludes an agreement with parents for supervision and care. The law says about supervision and care as follows:

Such clubs need to choose the OKVED code 88.91 - “Provision of services for day care for children”, it refers to social services. With such an OKVED, it is necessary to engage in social services. If you start preparing for school, this can be detected by a test. AT best case will cost the requirement to obtain a license or a warning, at worst - a fine or even suspension of the club.

Children's club "Raduzhka" was engaged in the supervision and care of children. The prosecutor's office came to the club, because twice a week the children were given lessons to prepare for school. The prosecutor's office found signs that the club was engaged in educational activities:

textbooks, copybooks, workbooks;

Kids are entertained in the club

There are entertainment clubs in almost every shopping center: you can leave your child there while you go shopping, or order a holiday, a show program, a quest. The club has a lot of toys, labyrinths, trampolines, slides, and animators, instructors, and organizers work with children. You can come and go at any time. There are no fixed classes, and parents pay by the hour or per event.

Such clubs operate under OKVED 93.29.9 - "Other entertainment and entertainment activities."

The club conducts general developmental classes

In the club with children they are engaged in creativity, dancing, sports. This is similar to educational activity, but classes do not have all the signs of educational activity and other OKVED codes.

Club activities are chosen by entrepreneurs who do not consider their activities educational. They call the centers leisure centers, hire specialists to work with children and instructors, and work without an educational program and a fixed schedule.

Natasha goes to the club for modeling and art therapy classes. Sometimes a mother has no time to take her daughter, and she misses classes. But it does not matter: the club does not have a strict schedule, no one evaluates the result. The main thing is that the child likes it.

From OKVEDov, 90.04.3 is suitable - "Activities of club-type institutions: clubs, palaces and houses of culture, houses of folk art."

With club activities, not everything is clear. In 2013, the Ministry of Education described how to organize additional education and listed its forms:

Nothing prevents circles, clubs and sections from being educational. Judgments on club affairs are different. Sometimes the courts take the side of entrepreneurs.

The prosecutor's office and the Ministry of Education checked the children's club "Merry Peas". The inspectors interviewed the owner, checked the site and documents, and this is what they found:

the program of preschool education "Childhood";

contracts with parents for training in the educational program;

medical books of teachers.

The court decided that the club was engaged in educational activities and fined him 4,000 rubles.

Educational activity is a set of features: consistency, result, obligation, duration, sequence. To prove that a license is not needed, you will have to show that there are no such signs in the classes, and confirm this with contracts and other documents.

The opinion of the owner of the children's club

Mikhail (this is a fake name) has children's centers in two cities and a franchise network. He told me what he thinks about licenses.

— I have two children's centers. In them we prepare children for school, we mental arithmetic, speed reading and calligraphy. Such centers did not need to be licensed until they passed in 2013 new law about education.

One of my children's centers operates with a license. Fifteen years ago, I began to engage in additional adult education, organized continuing education courses and received a license for additional education. Later I just added activities for children.

When I opened the second club in the shopping and office center, I also wanted to license it. We invited a fire inspector to check the premises, he knocked on the walls and said that plasterboard partitions would not work. At least one wall must be fireproof, so he did not give permission to work in this room.

It was expensive to change the place, but that's not even the problem. In our city, there are almost no premises with a fire exit and three toilets, as required for children's centers. Or the price for rent is such that the kids club can not pull.

If you license a club, checks will come every three years. I prepared for the last one for three months, lost four kilograms. But when there is no license, you are not on the lists of the Department of Education, and the check will come only if there is a complaint or force majeure. Therefore, I did not license one of the centers.

I veiled my educational activities: I took the club OKVED, I registered the teachers as instructors-moderators. It’s like we don’t teach anyone, we just spend time learning English. Many centers do just that.

For the center to develop, teachers are needed. But if there are teachers on staff, you need a license. To avoid licensing, managers either do not formalize teachers in any way, or formalize employment contract consultants and instructors.

Sometimes an individual entrepreneur takes the OKVED "rent" and "consulting activities", invites other individual entrepreneurs with teacher education and rents out his premises to them. That is, the entrepreneur himself does not keep the club, but gives a place for classes with children. He does not need a license and the invited entrepreneurs do not need it either - each of them works on his own. Everyone seems to be fine. The problem is that then each teacher needs to open a current account, set up an online cash register and accept money, conclude agreements with parents. Not every teacher will go for it.

Educational activities in the region are supervised by eight employees. According to the plan, they check kindergartens, schools, art houses and everyone who already has a license. They have no time to go to clubs. We also try not to give rise to inspections and comply with the laws: we register officially, pay taxes, and honestly deal with children.

Opinion of a legal consultant

— Requirements for small clubs with educational activities seem redundant. It is difficult for a club with two teachers and a couple of classes to work according to the rules that are written for art houses with four hundred children. But there are requirements of the law that relate to life and health, they must be met. For example, the law forbids opening clubs in the basement, because there is not enough daylight and fresh air.

Individual entrepreneurs do not need to obtain an opinion from the Ministry of Emergency Situations to obtain a license. But fire safety rules must be observed. Find suitable premises the hardest. I understand those who opened five to ten years ago: the place is familiar, you don’t want to leave and it’s expensive, as Mikhail says. But, if the manager decided to take this business seriously, I would recommend preparing for the move.

Scheduled inspections are usually held every three years. in education, social services, healthcare and some other areas - once every two years. It happens that scheduled inspections do not come at all. The reason for unscheduled is a complaint or a decision of the prosecutor's office.

Entrepreneurs often say: “I will work as I worked. What threatens me if they come? I'll pay the fine." But in addition to the fine, the inspectors will write a list of requirements that need to be corrected. If the demands are ignored, there will be a trial and, possibly, the suspension of the club. In other words, the owner either fulfills the requirements of the inspectors, or closes.
